Thank you for your enquiry of 4^th March 2019, in which you asked for
information held by The National Archives that notes or records in any way
the deferment of Suffolk Record Office's application for Archive Service
Accreditation.

Your request has been handled under the Freedom of Information (FOI) Act
2000. The FOI Act gives you the right to know whether we hold the
information you want and to have it communicated to you, subject to any
exemptions which may apply.

I can confirm that The National Archives holds information relevant to
your request.

We are pleased to be able to provide this information to you and have
enclosed it with this response.

Please note that Archive Service Accreditation was launched in 2013, with
an initial 4 year roll-out period for the programme. An expected timetable
was set for applications for Archive Service Accreditation by Places of
Deposit. These services could submit their applications throughout this
period, with final submissions made by the end of 2017” as we moved on
between 2013 and 2017 to recognise we’d have a lot of submissions in late
2017 that wouldn’t be assessed in year. It was only when we hadn’t had a
submission by year end that we considered it an extension.

Some of the information is covered by the exemption at section 40(2) of
the FOIA. Section 40 exempts personal information about a ‘third party’
(someone other than the requester), if revealing it would breach the terms
of Data Protection Legislation. Data Protection Legislation prevents
personal information from release if it would be unfair or at odds with
the reason why it was collected, or where the subject had officially
served notice that releasing it would cause them damage or distress.
Personal information must be processed lawfully, fairly and in a
transparent manner as set out by Art. 5 of the General Data Protection
Regulation (GDPR).

Section 41 (1) of the Act exempts information if (a) it was obtained by
the public authority from any other person (including another public
authority), and (b) the disclosure of the information to the public
(otherwise than under the Act) by the public authority holding it would
constitute a breach of confidence actionable by that or any other person.

The information contained in the record/ extract relates to information
that was given in confidence, the release of which could be actionable in
court. Although, for the purposes of the FOI Act, section 41 is an
absolute exemption, I can confirm that we have taken into account the
public interest defence test inherent within the common law duty of
confidence in reaching this decision.

For further information about why this exemption has been applied, please
see the explanatory Annex at the end of this letter.

If you are dissatisfied with the handling of your request or the decision
