I am writing to request an internal review of Oil and Gas Authority's handling of my FOI request 'Deed of Variation to PEDL 143'.

It has already taken longer than it reasonably should considering both the normal timescales for a FOI request, the precedents for the amount of time normally needed to answer other similar requests and lastly the urgent need for the public to examine the specifics of what other potentially environmentally damaging work is set out within the deeds of variation. The Transportation of Test drilling infrastructure within this fragile AONB may start within weeks.

Many thanks for sending those, I have to ask for clarification on some of these documents and whether this is in fact all the relevant documentation you have to disclose?

Specifically;

1. In the letter from the Department of Energy & Climate Change to Europa of 22 January 2010 a draft Deed of Variation enclosed is referred to which if signed and returned would have prevented the original Initial term from lapsing on 30/9/10 and would have extended it for 2 years. Where is this Deed of Variation? Without it the Licence lapsed.

2. I note the scan of the Deed of Variation dated 5 March 2010 with “2010” struck out and altered by hand to “2012”. This deed adds Clause 5(A) to the original Licence for the first time which allows for extensions to be agreed to the Initial term etc. but doesn’t itself change the length of a term. This Deed of Variation is marked “Duplicate” I request that the original document is also disclosed and explain the reasons for this below.

3. The letter from the Department of Energy & Climate Change to Europa dated 16 March 2012 refers to a letter from Europa (dated 29 December 2011 but not released as part of the FOI disclosure) giving notice pursuant to clause 5(A)3 requesting a one year extension to the Licence up to 30 Sept 2013. If the Deed of Variation that was re-dated 5 March 2012 was indeed signed on that day logically Europa could not have referred to it on 29 December 2011. I suggest the validity of this Deed of Variation is in doubt. If it is in fact from 5 March 2010 it is therefore the missing Deed referred to in point 1. but which clearly didn’t extend the Initial period and has subsequently been altered anyway which potentially invalidates the additional clause which permitted extensions to the Licence. If it is genuinely from 5 March 2012 then there would have been no power to extend the Licence before that date so again, PEDL 143 lapsed on 30/9/10. I request that any further documents held that refer to this altered Deed of Variation of 5 March 2010 or 2012 are now disclosed in the public interest.
