Decisions regarding re-appointment of Independent Members

At the July 2016 meeting of the Panel, decisions made at the previous meeting regarding the re-appointment of Independent Members were changed quite significantly. Can the report which the Panel relied on at the July 2016 meeting to make these decisions be made available.

Thank you for your request for information regarding Cumbria Police and
Crime Panel, which was received on 24^th October.

 

The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 21^st November.
Subject to the information not being exempt or containing any references
to third parties.

 

The council will, as a matter of routine make information available in
electronic format.  Where it is not practical to do this information will
be provided in hard copy (paper).  If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.

 

The Freedom of Information Act 2000 and Environmental Information
Regulations 2004 define a number of exemptions/exceptions which may
prevent information being released to you automatically.  The council will
make an assessment about the application of any exemptions/exceptions and
issue you with a decision letter, which will include details of your right
to appeal.

 

If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.

 

In accordance with the council’s [1]Charging Policy a fee may be charged
for supplying information.  If a fee is payable you will be issued with a
fees notice.  The applicable fee must be paid in full before the
information is processed and released.  The statutory time limit for
responses is suspended until the council has received and processed your
payment.  If payment is not received within three months of issuing the
fees notice your request will be closed.

Dear Information Governance,

My request for the report which the Panel considered before making the following decisions has not been properly answered. On 15 July 2016 the Panel took the following decisions when approving the minutes of the previous meeting:

• the amendment of minute no 99(1) to amend the Panel’s rules of procedure to allow for independent co-opted members to be reappointed without the need for an election provided the individual members were willing to be reappointed;
• the amendment of minute no 99(2) to state that the term of office of Ms L Vance and Mrs J Cooke being continued for 4 years (rather than the 2 years shown in minute)

My request was to see the report which the Panel took into account before considering this matter. Instead I have been sent the link to a report on Member allowances which has nothing to do with the term of office of independent members. Therefore I am asking again to see the report concerning the appointment of independent members which the Panel considered at its July 2016 meeting before taking decisions on this matter. Also, there is no mention on the agenda for this meeting that a decision on the appointment of independent members was to be taken. In the light of the absence of any notice about the intention to transact this business and given the apparent lack of any written report can the Monitoring Officer confirm the Panel acted in accordance with the access to information rules that the Panel is legally obliged to follow.
