Dear Ms A Tanner,

 

Thank you for your email dated 9 November 2011 requesting the following
information under the Freedom of Information Act 2000 (FOIA):-

 

"that their was no requirement by your office to register the following as
a pending action.

Debtor's petitions not required to be registered as Pending Petitions (pre
6 April 2016)."

 

Section 86(2) of the Land Registration Act 2002 states that we must make a
notice in the register in respect of a petition in bankruptcy after it is
registered as a pending action under the Land Charges Act 1972.

 

That provision applied to debtors' petitions in bankruptcy before April
2016 as well as to creditors' petitions.

 

Rule 6.43 of the Insolvency Rules 1986 required the court in which the
petition had been filed to notify us of the petition so that it could be
registered under the Land Charges Act 1972.

an internal review within two months of the date of our reply. Internal
reviews will be dealt within 20 working days. If at the end of this time
