Deaths of patients with a learning disability and serious incidents

2) the number of deaths of patients with a learning disability reported as an incident on the National Reporting and Learning System (NLRS) in the last three years (defined as above)

3) the number of deaths of patients with a learning disability reported as an incident on the Strategic Executive Information System (STEIS) in the last three years (defined as above)

We are writing further to your Freedom of Information request dated 8th March 2019 as follows:

Please could you provide more specific information about what you mean by “learning disabilities”. This is a general term and in order to gather the data you request we will need to search by specific diagnoses. Please let us know which specific diagnoses you would like us to include in our search.

Dear Carol,

Thank you for responding so promptly and for seeking clarification. I am aware that learning disability is a general term and I am not sure how diagnoses specific searches would work. Someone is disabled under the Equality Act 2010 if they have a physical or mental impairment that has a ‘substantial’ and ‘long-term’ negative effect on their ability to do normal daily activities. I'm not sure if that will help?

I notice from your NRLS data that you have made returns for serious incidents that have occurred in learning disability services. While I'm interested in all services, not just those provided under the auspices of LD Services, presumably you must have a definition of who is eligible for learning disability services - I guess that is the definition that would be most relevant to use for my query.

• Is the death of patient in hospital or community?
• Was the patient under LD services at the time of their death?
• For example: A patient may used LD services in 2012 and subsequently discharged from the service and died in 2016. Question is do we include that patient for this request?

Dear Carol,

I'm interested in all deaths of patients with a learning disability. So if someone once used one of your services in 2012, and was discharged from the service and received no further support, had no contact with services and died 4yrs later, I imagine they wouldn't be included.

However if a patient had a learning disability and was an 'active patient', as an inpatient or in the community, at the time of their death. Perhaps also if they'd been recently discharged from the service, say within the last 30 days, then I'd hope they were included too.

To be honest it's up to you how you define things, but to answer your earlier questions:

> Was the patient under LD services at the time of their death? Please include
