FOI (THE ROYAL ORTHOPAEDIC HOSPITAL NHS FOUNDATION TRUST), The Royal Orthopaedic Hospital NHS Foundation Trust

Dear Dr Julian

Can I please ask for some clarification so we can respond to your FOI request.

Can you please clarify your definition of 'Learning Disability', particularly if this includes learning difficulties and whether this include conditions such as dyslexia, tourette's syndrome, etc?

Many thanks.

Dear FOI (THE ROYAL ORTHOPAEDIC HOSPITAL NHS FOUNDATION TRUST),

Thank you for your email. I'm using the definition from the 2010 Equality Act that refers to a mental impairment that has a ‘substantial’ and ‘long-term’ negative effect on someone's ability to do normal daily activities.

I would not anticipate that patients with dyslexia or tourette's syndrome would fall into this category unless those diagnoses were accompanied by a learning disability.

Many thanks
George
