Thank you for your recent request under the Freedom of Information Act
2000.

 

The information you have requested is as follows:

 

1.        the number of deaths of patients with a learning disability that
occurred in the last three years (by years defined as 1/4/16 - 31/3/17,
1/4/17 - 31/3/18, 1/4/18 to present).

Medway NHS Foundation Trust’s Safeguarding and Learning Disability Liaison
are aware of 32 LD deaths overall in the past 3 years – this is not broken
down by year for reporting and will not include the deaths of children
(upto the age of 18) with a learning disability.

 

2.       the number of deaths of patients with a learning disability
reported as an incident on the National Reporting and Learning System
(NLRS) in the last three years (defined as above)

17 patients have been referred to the LeDeR mortality review programme

 

3.        the number of deaths of patients with a learning disability
reported as an incident on the Strategic Executive Information System
(STEIS) in the last three years (defined as above)

The Safeguarding and Learning Disability Liaison are aware of less than
five cases that were recorded on STEIS as Serious Incidents and a further
high level investigation.

           

Medway NHS Foundation Trust regret that the we are unable to confirm the
exact number as the number is so low and there is the potential that
individuals could be identified.  However, the Trust can confirm the
number is less than five across the last three years.  The Trust takes the
view that this information is exempt from disclosure in accordance with
section 41(1)(a) and (b) of the 2000 Act.  The reason why the Trust takes
this view is because the number is low and with this, and any other
publicly available information, the public could identify the deceased
through association.  The Trust believes that the information relating to
patients carries a duty of inferred confidence and that the release of
such information would breach that trust.  This duty continues regardless
of whether they are alive or deceased and extends in the protection of
their families from inappropriate intrusion.  A Public Interest Test and
review of Information Commissioner Guidance supported the proposed
position.

 

I hope that this gives you the answer you need, but if you are

Please could you clarify the answer to Question 2 please. I did not ask about LEDER reviews, I asked about the number of learning disabled patient deaths that had been recorded on NRLS in each of the previous three years.

I'd appreciate it if someone could answer the question please.

After reviewing your request and the response given, I confirm that the
Trust are unable to respond to the question regarding learning disability
(LD) deaths reported on NRLS as this data is not recorded.  This is
because there is no category for LD on either the Trust’s Datix system or
NRLS, it is recorded by the severity of harm being ‘death’ caused by the
incident.  All deaths are reviewed through the mortality review meetings
and all learning disability deaths are referred to LEDER. 

 

For information, the NRLS publish data 6 monthly which is available for
anyone to view online on the NHS Improvement website. Within these
published summaries there is data on total number of deaths reported by
each organisation but it is not broken down into whether or not they are
LD patients.

 

Apologies that this was not explained fully in the Trust’s earlier
response, but I hope that this now clarifies the response.
