I would like to request the following information under the Freedom of Information Act.

1) How many children, who were known to your social services department, died between 1st January 2017 – 30th November 2021? (Including those dates)
1i. Please specify how many of those occurred in each year - 2017, 2018, 2019, 2020, 2021.
1ii. Please provide the ages of the children, and the cause of death.

2) How many children, who were known to your social services department, were admitted to hospital with malnourishment between 1st January 2017 – 30th November 2021? (Including those dates)

Further to your request for information received on 6^th December 2021,
please see below response.

 

RESPONSE

The information management team have suppressed any figure of 5 or less to
protect the anonymity of the data subjects, therefore this information is
exempt from disclosure under Section 40(2) of the FOI Act.

 

Section 40(2) is an absolute exemption therefore, there is no requirement
to determine the public interest in disclosure.

 

Unfortunately there is no response to Question 2 of your request, as BCP
Council do not hold this information in a reportable format, and would
have to manually trawl through over 10,000 records to try and find this
information, which would exceed the 18 hour cost limit.

 

The Freedom of Information (Fees and Appropriate Limit) Regulations 2004
specifies an “appropriate limit” for the amount of time the Council needs
to spend undertaking that search. If the Council estimates that the time
to taken to locate, retrieve and extract the information requested will
exceed the appropriate limit, then under Section 12 of the Act, it is
therefore not obliged to comply with that request. 

 

The appropriate limit currently specified by the Regulations for local
authorities is £450. This represents the estimated cost of one person
spending two and a half working days in locating, retrieving and
extracting the information requested. We estimate that the cumulative time
it would take officers to locate and retrieve the data would take several
weeks and exceed the appropriate limit as a manual search of records held
from 2013 and 2014 would be required. We are therefore unable to disclose
the information you require.  

 

We are unable to offer advice and assistance under section 16 of the Act
as our data is not held in a manner that could provide the information
requested within the 18 hours time limit. It would require us to manually
access records and therefore cannot be produced within timescales as
specified under the Act.
