Simon Baker, Nursing and Midwifery Council

Ref no: FOI/2017/452

5^th December 2017

Dear Ms Hughes,

Freedom of Information Request

Thank you for your request for information from the Nursing and Midwifery
Council (NMC). Your request was received on 9^th November 2017 and dealt
with under the terms of the Freedom of Information Act 2000 (FOI Act).

You have asked for the following information:

‘Please will you tell me how many nurses and midwives died
in the last 5 years for which statistics are available, preferably 2012 to
2016 inclusive, whilst under referral to or investigation by the NMC?
Please will you supply the

                numbers per profession?’

Response

To answer this question would require manually searching the records of
cases closed in the time period 2012 to 2016 as the NMC does not hold the
data in a meaningful way for closed cases recording the reasons for a case
closure and that would allow us to search all records within the timeframe
of 18 hours. Therefore this request will be exempt from disclosure under
s12 of the FOI Act as the cost of compliance would exceed the appropriate
limit. If you were to narrow down your request in this area to the period
2015-2016, for example, it may be possible that meeting the request would
not exceed the 18 hour limit although unfortunately I cannot guarantee
this.

End of Response.

If you are not satisfied with the way we have dealt with your request for
information under the FoIA, in accordance with the Statutory Code of
Practice issued under s. 45 FoIA, you may complain to the NMC. You should
submit any complaint in writing within 28 days to:

Clementine Adewunmi
Records and Archives Manager
Nursing and Midwifery Council

This will be investigated in line with our internal complaints procedure.
If you are not satisfied with the outcome, you should then contact the
Information Commissioner (as an appeal under s. 50 FoIA) by writing to:
