Dear Health and Safety Executive,

I refer to my request relating to the death of Robert Fidoe full deatils of which can be found at - http://www.whatdotheyknow.com/request/de... and the response given by Mrs Belinda Hall (Reference No: 2012070290).

Mrs Halls reply states that the incident is the subject of ongoing criminal proceedings and the information I have requested is exempt from disclosure under section 31(1) of the Act.

The three factors you give for non disclosure are -

'Impede the chances of a fair trial occurring'

'Impede the chances of a successful prosecution occurring'.

'Inhibit other ongoing/potential proceedings'.

In order to promote transparency and maintain public confidence, can you please provide a small subset of the information requested (if held) which I do not believe is exempt using the public interest test -

(1) The date and time that a trial will take place.

(2) The names of the defendants (organisations or individuals)

(3) The charge(s).

I understand that this is normal practice in law enforcement.

I am writing to request an internal review of Health and Safety Executive's handling of my FOI request 'Death of Robert Fidoe'.

As you will note, I have received two contradictory refusal notices relating to this matter.

May I ask the reviewing officer to

1. Provide a detailed explanation of how this situation occurred.

2. Provide the information I have requested or provide a more considered refusal notice.

HSE's contradictory response so far on this matter does little to promote transparency in the process of law enforcement or maintain public confidence in litigation.
