Dear Derbyshire Constabulary,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Derbyshire Constabulary's handling of my FOI request 'Death of Police Officers whilst under investigation for Misconduct'.

I would like to know why this information is not recorded and why you feel that you cannot find this out. Surely the misconduct investigation could not be finished / closed "due to death" and would be recorded as such. This should not be difficult to find out.

I am writing to all forces and have had some information from others. I am requesting this information so that it is transparent for members of the public and for the families that believe the death of their child/son/daughter/husband/ wife died due to the stress caused by an investigation.

Please review this request

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/d...

Yours faithfully,

Victoria Harper

Ms Harper

Thank you for your email concerning the above.

Whilst I am happy to arrange an internal review some clarification in the
first instance may be of assistance.  My initial response read:

‘Following receipt of your request, searches were conducted within
Derbyshire Constabulary to locate any relevant information.  The searches
did not locate any information relevant to your request.  As a consequence
the position of the Constabulary is ‘no information held’.

You state within your email that you 'would like to know why this
information is not recorded and why you feel that (I) cannot find this
out.  Surely the misconduct investigation could not be finished / closed
"due to death" and would be recorded as such.  You conclude that 'This
should not be difficult to find out'.

In truth it wasn’t difficult to find out.  Searches were conducted to
locate any relevant information, i.e. incidents of death of police
officers whilst under investigation for misconduct  and these proved
negative because we have had no such incidents recorded; hence ‘No
information held’.

I hope this clarifies the issue for you.  If so could you please let me
know whether or not you still require a review to be conducted.  Pending
this I have placed your request on hold.

I look forward to your response.

Yours sincerely

Dear Freedom of Information Office,

I have sent this request to all forces in the UK. If there have been no instances of death whilst under investigation I have been furnished with a reply to say “no deaths” or if there have I’ve been given a number. Information not held has meant - they do not have this information.

By your initial reply you did not tell me there had been no deaths. You said information not held. If you are telling me that you have looked and there are no instances then that will suffice. HOWEVER I would like this brought to the attention for an internal review so that this does not happen again

Thank you

Yours sincerely,

Victoria Harper
