Enquiry Ref: 11614/2020

I write in connection with your request for information dated 12th January 2020 and received by this office on 13th January 2020. Below are the questions raised in your request and our response.

I would like to know the incidents of death of police officers whilst under investigation for misconduct. Both natural and suicide.
a) As there is no timescale detailed on your request we have looked at the last five years. Having made enquiries within the force our response, on this occasion, is none.
If this is not recorded I would like to know why?
a) We do not consider that this question is a valid request for information as it is asking for opinion and not specific information held and is therefore exempt under s8(1)(c) of the Freedom of Information Act.

Please note any statistical data supplied in relation to Freedom of Information requests is a snapshot of data held at the time the request was received by the Freedom of Information office and is subject to constant change/updates.

The Cleveland Police response to your request is unique and it should be noted that Police Forces do not use generic systems or identical procedures to capture and record data therefore responses from Cleveland Police should not be used as a comparison with any other force response you receive.

If you are not satisfied with this response or any actions taken in dealing with your request you have the right to request an independent internal review of your case under our review procedure. The APP College of Policing guidance states that a request for internal review should be made within 20 working days of the date on this response or 40 working days if extenuating circumstances to account for the delay can be evidenced.

If we can be of any further assistance please do not hesitate to contact this office.

Yours sincerely,

Dear Freedom of Information,

I have asked this question of all forces in the UK and have been supplied information. I only want to know numbers e.g. Northern Ireland supplied "1", Yorkshire "5".

If PSD search their cases - the ones that could not be finalised could be searched and those with "due to death" would then provide the statistics.

Please can I request an internal review

Yours sincerely,

Victoria Harper

Freedom of Information, Cleveland Police

Dear Ms Harper

In response to your request for an internal review and could you please clarify the reason for the review as we have answered your question, except the part asking for an opinion which is not valid under S8(1)(c) of the Freedom of Information.

This will not be forwarded on to the independent reviewer until we receive your response.

Yours sincerely
