Dear Wirral Metropolitan Borough Council,

I recently asked Dawn-Stanley-Smith, the customer resolution & information manager if she had any recorded information concerning Looked After Children in your care who's mother had committed suicide within the last two years.

She refused to answer my query, and suggested that I contacted you personally Jane to ask her for this information.

I know it seems silly but for the record can you supply me with her answer or the recorded information she has in her possession concerning my request.

Having now received written confirmation that Miss Coffey, the Strategic Service Manager for children in care that "she was aware of three mothers of children who had died during 2011/2012."

Will you now supply me with any recorded information (redacted as necessary of course) that you have in connection with these tragic events?

Good Afternoon,

Thank you for your enquiry below. 

 

I consider that the information you are seeking with regard to looked
after children is exempt information under Section 40(2) of the Freedom of
Information Act 2000.  This is because the information in question
constitutes personal data in that disclosure relates directly to living
individuals and disclosure of this data would contravene both the first
and second data protection principles.

 

Contravention of the first data protection principle would occur as it
requires that personal data shall be processed fairly and lawfully and
shall not be processed unless at least one of the conditions in Schedule 2
of the Data Protection Act 1998 is met.  I do not consider that any of the
conditions in Schedule 2 would be met for the processing of this data.
Specifically, I do not consider that the processing is necessary for the
purposes of exercising or performing any right or obligation which is
conferred or imposed by law on the data controller - Wirral Council.    I
have also considered that disclosure of the information would contravene
the second principle which requires personal data to be obtained only for
one or more specified and lawful purposes, and shall not be further
processed in any manner incompatible with that purpose or those purposes.

 

Please note that I am unable to confirm or deny that the information you
have requested is held by the Council and have relied on section 40, (5)
of the Freedom of Information Act 2000 which states that:   “The public
authority is not obliged to confirm or deny whether it holds other
personal data if to do so would contravene data protection principles…”

In reaching this view I have taken note of the advice given by the
Information Commissioner “Personal information (section 40 and regulation
13) 20130424 Version: 1.0”    

 

 I am therefore refusing this part of your request for information under
Section 17 (1) of Freedom of Information Act 2000, on the basis of the
exemption contained in Section 40(2) of the Freedom of Information Act
2000.

If you are dissatisfied with the Council’s response, you have the right to
ask for an internal review which should be sent to Legal and Member
Services, Wirral Borough Council, Town Hall, Brighton Street, Wallasey,
CH44 8ED or emailed to [1][Wirral Borough Council request email]  and it will
be assigned to an independent officer.

 

If you are dissatisfied with this response to your request for
information, you also have the right to complain to the Information
Commissioner, who would normally expect you to have requested an internal

Dear InfoMgr, FinDMT,
I have a letter sent to me from a director of Wirral CYPD admitting to me that three mothers of children in Wirral's care
have indeed committed suicide last year, so how can you now refuse this request?

Has this Director lied to me or is this the real truth or has she lied on this matter a simple yes or no to this question is requested from you Jane please?
