Freedom of Information Request – Response

 

Section 1 of the Freedom of Information Act 2000 provides two distinct but
related rights of access to information which impose corresponding duties
on public authorities.  These are:

 

o The duty to inform the applicant whether or not information is held by
the authority and, if so,
o The duty to communicate that information to the applicant.

 

Thank you for your request of 6 November 2019 for the following
information:

 
How much Section 106 money, from which companies, at what dates, will be
returned to its donors if it is not spent by Redbridge Council for what
designated periods.

 

Your request has been considered.  Please find below the correspondence
relating to your request.

 

As per the National Planning Policy Guidance, ‘Local planning authorities
are expected to use all of the funding received by way of planning
obligations, as set out in individual agreements, in order to make
development acceptable in planning terms. Agreements should normally
include clauses stating when and how the funds will be used by and allow
for their return, after an agreed period of time, where they are not’
(para: 021 Reference ID: 23b-021-20190315)(15/3/19).

 

All agreements are available on the Councils Planning section on the
website. This shows where monies are to be spent, and sets out the dates
of return, if applicable to those monies. They will also state the
companies or developers who have paid these monies.

 

If the agreement does not appear on the website, a copy can be sent
across.
