Your request for information, with reference number FOI 2211291246 has now
been considered and the information requested is given below.  

 

Request and Response

Concerning the present contract with Carter security Solutions Ltd (CSS):

 

1. Please confirm whether or not the contracted security staff have
received data protection act/GDPR training? If so when this was for each
member of staff and whether the Council have had sight of the training
having been signed off?
 

CSS staff have received training from the Council on how to operate their
handheld devices and the contract governs how they are to collect and
process the personal data in accordance with data protection
legislation.  Please contact CSS direct to discuss any additional GDPR
training they may have provided. 

2. Please provide a copy of the contract with CSS Limited to also show
what information is to be provided to the council as part of the contract.

 

Please be advised that we are unable to provide a copy of the contract
with CSS Limited.  The exemption we are applying is section 43 -
commercial interests, as permitted by the FOIA.

 

The public interest test has been applied and in all the circumstances of
the case the council considers that the public interest in maintaining the
exemption is greater than the public interest in disclosure.  The council
acknowledges that there will always be a general public interest in
promoting transparency and public understanding about the decisions of the
authority, however in this case it is believed that the public interest is
greater served by preserving our ability to protect contractual
obligations.
 

We can, however, confirm the Council’s personal data instructions, within
the contract, says that the purpose of processing the data is for public
engagement, reassurance and enforcement of the Public Space Protection
Order (PSPO) in the city centre by issuing Fixed Penalty Notices (FPN),
use of the dispersal to prevent and stop anti-social behaviour and the
collation of evidence to allow for other enforcement measures to take
place.   

 

The types of personal data being processed are:   

Name, Address, Date of birth of members of the public, the Offence
Location, Offence Details, Description of individual and offence for
statement and date of offence.

I am writing to request an internal review of Peterborough City Council's handling of my FOI request 'Data Protection training for contracted enforcement officers'.

1. You have failed to confirm whether or not you have ensured that the contracted security officers have received formal training with regards to data protection act / GDPR. This should be part of due diligence, please revisit this as part of the internal review.

2. You have not provided a copy of the contract which can be redacted to exclude any financial agreement.
