FOI East, Cheshire East Council

Dear Mr Thomson

Thank you for your request for information about the number of times Cheshire East Council was found to have breached the Data Protection Act in 2014. I can confirm that Cheshire East Council was found to have likely breached the Data Protection Act four times in 2014. On two occasions, the breach related to email addresses being visible to other recipients, one related to not responding to a subject access request within 40 days and one related to excessive data being disclosed. All four incidents resulted in no regulatory action by the Information Commissioner’s Office.

I trust this satisfies your request but if you are unhappy with the service you have received in relation to your request and wish to make a complaint or request a review, under the Freedom of Information Act you should write to Compliance & Customer Relations, Cheshire East Council, 1st floor, Westfields, c/o Municipal Buildings, Earle Street, Crewe, Cheshire CW1 2BJ or email [Cheshire East Council request email].

If you are not content with the outcome of your complaint, you may apply directly to the Information Commissioner for a decision. Generally, the ICO cannot make a decision unless you have exhausted the complaints procedure provided by the Council. The Information Commissioner can be contacted at: The Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF, www.ico.org.uk.

Yours sincerely
