Data Protection Act Breach & £80,000 Fine

The request was successful.

Dear North East Lincolnshire Council,

Please refer to article published on 29 October, 2013 on the Grimsby Telegraph's website entitled: "North East Lincolnshire Council fined for losing memory stick containing personal data of 286 children"

http://www.grimsbytelegraph.co.uk/North-...

The Information Commissioner has fined North East Lincolnshire Council £80,000 for carelessly handling sensitive data; who will bare the cost of this?

If the council / taxpayer, how many hours does this equate to that has been diverted away from caring for the elderly?

Yours faithfully,

PPD - FOI, North East Lincolnshire Council

Dear Mr Frodham

Thank you for your information request 6076_1314, concerning the penalty
issued by the Information Commissioner.

Your first question asked ‘The Information Commissioner has fined North
East Lincolnshire Council £80,000 for carelessly handling sensitive data;
who will bare the cost of this?’

North East Lincolnshire Council has paid the fine of £64,000. The initial
fine for £80,000 has been reduced by 20% for prompt payment. Monies
received from Information Commissioner Office levied fines goes back,
broadly speaking, to central government general funds and therefore the
£64,000 will remain ‘public money’.

Your second question asked ‘If the council / taxpayer, how many hours does
this equate to that has been diverted away from caring for the elderly?’

No funding will be diverted from services caring for the elderly, as a
consequence of the fine.

Further information on how North East Lincolnshire Council is handling
this matter and the improvements made to our policies, training and
procedures to prevent another incident like this happening again, can be
found on our website at
[1]http://www.nelincs.gov.uk/council/the-co...

If you are unhappy with the response you have received, you have the right
to request an internal review by the Council. If following this you are
still dissatisfied you may contact the Office of the Information
Commissioner. If you wish to request an internal review, please contact me
and I will make the necessary arrangements.

Yours sincerely on behalf of North East Lincolnshire Council
