Data on staff leaving as a result of a dispute

Response to this request is long overdue. By law, under all circumstances, North West Ambulance Service NHS Trust should have responded by now (details). You can complain by requesting an internal review.

Dear North West Ambulance Service NHS Trust,

I am looking at how effectively cases are managed where an employee leaves the NHS as a result of a dispute. Under the Freedom of Information Act, please can you provide the information I have set out below.

For the past 5 financial years (01 April 2006 – 31 March 2011), please provide the total number of employees who have left the Trust. Of these, please list for each case where you were made aware the employee left because of a dispute:

a. Was the employee offered a settlement/compromise agreement? If so:
i. Was an agreement reached?
ii. Payment made (in bands of £10k if preferred)?

b. Were Employment Tribunal proceedings issued against the Trust? If so:
i. Did it reach the hearing?
ii. Did the hearing reach a judgement? (ie not settled prior to judgement or withdrawn by the employee)
iii. What was the outcome/award (in £10k bands if preferred)?

c. What did it cost you in legal advice/fees?

I haven’t asked for details of the type of dispute or dates, and do not expect the information to be provided in chronological order, so it cannot be linked with any information that may already be published about the cases.

If you don’t record all the details I’ve asked for, please provide as much of the details I’ve asked for as you do have and explain gaps or note if specific details about individual cases are not available.

If you estimate it will exceed the limit to extract the information you hold, please extract what you can within the time limit in the following order of preference:

1. Complete dataset (or as complete a dataset as you have) for as long as it is available, starting from most recent

2. Partial datasets available for the remainder of the time period, most recent first, until the time limit is reached

Please let me know if you have any queries or require any clarification of what I have requested. Otherwise, I will look forward to receiving the information you can provide within the statutory 20 working day time limit.
