The request was refused by Derby City Council.

Dear Derby City Council,

I am looking for data on out of town landlords who own property in Derby City. This could be an investment company or an individual whose home address is based outside of Derby.

I am looking for details of their home address in order to contact them regarding possible further investment into Derby which would benefit Derby City.

We look forward to hearing from you.

Yours faithfully,

Param Singh

Dear Param Singh

Your request for information will not be processed.

This is because the cost of locating and retrieving the information
exceeds the ‘appropriate limit’ as stated in the Freedom of Information
and Data Protection (appropriate limit and fees) regulations 2004.

In accordance with the Freedom of Information Act 2000 this letter acts as
a Refusal Notice.

Section 12: Exceeds Appropriate Limit

It is not possible to electronically produce a report that would
automatically separate out the ‘out of town landlords who own property in
Derby City’ from the records we hold.

In order to provide this information, we would have to manually trawl
through our records to identify which would fulfil the criteria and then
we would have to manually collate the relevant information.  Therefore
to provide a response will more than exceed the appropriate limit of 18
hours.

In addition to this, we are unable to provide contact details of
individuals as this constitutes personal information.  This falls within
the scope of the Data Protection act 1998 and disclosure without consent
would be unlawful under the act.

In accordance with the Freedom of Information Act 2000 this email acts as
a Part Refusal Notice.

The exemption applied is section 40(2) and 40(3)(b) – Personal Data

I apologise that your request will not be met but if you have any further
information needs in the future then please contact me.

You can ask for this decision to be reviewed under the Council’s FOI
Complaints Procedure. I enclose a copy of the procedure. If you wish to
appeal please set out, in writing, your grounds of appeal and send to the:

Freedom of Information Officer

Derby City Council

The Council House
Corporation Street
Derby
DE1 2FS

Telephone 01332 640763 or e-mail [1][Derby City Council request email]

You may also apply to the Information Commissioner for a decision under
section 50 of the Act but he may decline to deal with your application if
you have not followed the Council’s complaints procedure first.

Any application to the Information Commissioner should be sent to:

Information Commissioner's Office
Wycliffe House
Water Lane
Wilmslow
Cheshire
SK9 5AF
Telephone:   01625 545 700
