Dear Rhi Storer,

Please clarify the following, so we can search if we hold the information
requested.

 

1. I would data on council accounts for each year from 2014 - present
which would include disposals of social assets.

What do you mean by social assets?  For example, do you mean disposal of
properties owned by the Council.  Please list all categories that ‘social
assets’ cover for your request.

 

We won’t be able to deal with your request until you provide the
additional information.   

The Freedom of Information Act 2000 says that we must comply with your
request for information within 20 working days, from the date following
receipt of your request unless we have to ask for clarification, as in
this case. The 20 day response deadline clock has stopped from the date of
this email, the clock will reset from the date we receive your response
clarifying your request and we will advise you of the new 20 working day
deadline at this stage.

Unfortunately, if we don’t hear from you by 3/4/20, we will send you a
refusal notice because we have not received all the information we need to
deal with your request.

Further to the clarification request sent to you on 03/02/2020 attached
please see the additional clarification request below including the
clarification that was sought on 03/02/20.

 

Unfortunately, the Council is unable to identify the information you have
requested from the details in your request.

 

Q.1. I would data on council accounts for each year from 2014 - present
which would include disposals of social assets.

 

 

-        What do you mean by social assets?  For example, do you mean
disposal of properties owned by the Council.  Please list all categories
that ‘social assets’ cover for your request.

-        Is the request merely asking for a copy of the Statement of
Account from 2014 to present? 

-        Or is the request specifically for data relating to social asset
disposals only?

-        By social assets are they referring to social housing or social
care homes, or both? If both, exactly what data is being requested, the
no. of properties sold & proceeds received?

 

We won’t be able to deal with your request until you provide the
additional information.

For clarification, I am looking for data from your council noting how many care homes have changed hands from council-owned to under a private name or contractor. I would like to find this information related to adult care homes, including names and years from 2014 - present.

Dear Rhi Storer,

 

Thank you for your clarification response received on 10/2/20 about your
request under the Freedom of Information  Act 2000 (FOIA) for ‘Council
finance and assets’.

 

The Council is considering your request and although the Act says we
should disclose information, it also provides exemptions we can use to
withhold information in specific circumstances. 

 

Some of these exemptions, referred to as ‘qualified exemptions’, are
subject to a public interest test.  This test is used to balance the
public interest in disclosure against the public interest in favour of
withholding the information.

 

In these circumstances the Act allows us to extend the response deadline
by 20 working days to consider the public interest test. 

 

Section 22: Intended for future publication

 

This exemption applies to the transaction value of the sold assets because
the information will be published on the Land Registry site in due
course. 

 

We have extended the 20 working day response period and will let you have
a full response by 06/04/2020 or earlier if possible.

 

You can ask for our decision to be reviewed under the Council’s FOI
