Data of how direct payments are being used by users

Dean made this Freedom of Information request to Caerphilly County Borough Council Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

The request was partially successful.

Dear Caerphilly County Borough Council,

Could you provide any data you hold regarding what direct payments are specifically being used for by users? The more comprehensive and specific this list is, the better. For example, data showing DPs being used for a gym membership would be far better than data showing DPs being used for "leisure activities" which would be too broad and nonspecific.

If you require dates to extract this data could you extract it from the last five financial years as follows:

• 2018-2019
• 2019-2020
• 2020-2021
• 2021-2022
• 2022-2023

Yours faithfully,

Dean

FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Thank you for your request for information received on the 16^th May 2023.

We can confirm that the Council holds information falling within the
description specified in your request, but we are refusing to supply this
information under Section 12 of the Freedom of Information Act 2000.

We estimate that the cost of complying with your request would exceed the
appropriate limit of £450 for local government, which is specified in the
Freedom of Information and Data Protection (Appropriate Limits and Fees)
Regulations 2004. Therefore, we are refusing to supply this information
under Section 12 of the Freedom of Information Act 2000.

In order to determine whether your request exceeds this limit, we must
multiply an estimate of the time we expect to take to comply with your
request by £25 per hour.  If the cost of complying with your request would
exceed the appropriate limit of £450 (more than 18 hours), we can refuse
your request.  In making this calculation we are able to include the time
taken to determine whether we hold the information and time taken to
locate, retrieve and extract the information.  The hourly rate of £25 per
hour is set by the Fees Regulations and is not dependent on the seniority
of the officer who carries out the work.

Under the Freedom of Information Act, we a have a duty to provide advice
and assistance to help you narrow, reform or refocus your request so that
the cost of complying with it falls below the appropriate limit of £450.
Unfortunately, on this occasion, as the information requires the
examination of more than 250 cases with 1200 records for each year to
extract the information requested, we are unable provide the detail
requested without exceeding the appropriate fees limit.

If you have any queries or concerns or are in any way dissatisfied with
the handling of your request please contact us.

Dear WWW: FOI,

I have further refined my request which I have included in full below. I hope this helps.

☆For the attention of Adult Social Services☆

The term data in the heading above refers to the actual activity/service/goods that a direct payment was/is used for and not just the broader category that it falls within. Of course, the broader category can be included as well. Where direct payments are used for personal assistants (PA), these can be excluded from the dataset.

The primary purpose of this request is to receive a full breakdown of how individual users spend their direct payments. The amount of each payment would be very useful but not essential. The total direct payment amount each person receives is important though and this can be displayed weekly or monthly or whichever is easiest for you.

So, as I have mentioned, please provide all data in relation to how direct payments are specifically being used by users aged 24 - 54 and all other age groups can be excluded. The more comprehensive and detailed this list is, the more useful it will be for this FOI request. For example, data showing DPs being used for a gym membership (including how much it costs) would be far more valuable than data showing DPs being used for "leisure activities" which would be too broad; nonspecific and unhelpful.

If you require dates to extract this data could you extract it from either of the following financial years (preferably both):

• 2018-2019
• 2022-2023

I appreciate that this data can be quite laborious at times, especially if extracting the data from a manual trawl of individual care and support plans. It may or may not be easier to consider past audits and current monitoring systems to extract the same data and always remember to keep it within the age parameters of 24 - 54 which should exclude the majority of users.

To compliment the core request, could you kindly send me your direct payments policy including your practice guidance for practitioners. Could you also send me your Care and Support Planning Policy along with your practice guidance for practitioners. Please send any other policies you feel are relevant or related to the policies and practice guidance documents requested above.

Yours sincerely,

Dean

Thank-you for your email received on 7th June.

Unfortunately, due to the manner in which our records are held, the refinement of a time period would exceed the Appropriate Limit.

We are unable to answer your request as all continued cases that have been in receipt of Direct Payment would need be examined. The information requested is not recorded separately as it is not required to be recorded for our purposes. Each case file will would need to be reviewed to extract the purpose of each Direct Payment.

Could you also provide your policies and practice guidance documents which govern how "Care and Support Plans" must be developed. Again, particularly those which serve as practice guidance for practitioners.

Could you also provide your policies/documents and any practice guidance documents regarding home care charges and how this calculation is determined and allocated in the context of direct payments. FREEDOM OF INFORMATION ACT 2000 - INFORMATION REQUEST

Thank you for your request for information received on the 23^rd June
2023. We have considered your request and enclose the following
information -

 1. Could you kindly provide ALL of your policies related to direct
payments (particularly those which serve as practice guidance for
practitioners).

Please find the CCBC Direct Payments Policy attached.

 2. Could you also provide your policies and practice guidance documents
which govern how "Care and Support Plans" must be developed. Again,
particularly those which serve as practice guidance for practitioners.

All CCBC practitioners work to the Social Services and Well-Being act
(Wales) 2014, and the Code of Practices are in the public domain and can

links:

 3. Could you also provide your policies/documents and any practice
guidance documents regarding home care charges and how this
calculation is determined and allocated in the context of direct
payments. For example, how do you calculate the cost of providing
meals to a person who is unable to shop for, prepare or cook their
meals and how would this cost be equated in the form of a direct
payment.

The policy documents regarding Home care charges are not publicly
available.

Home care charges are worked out following the Social Work assessments and
the care plan advises how many hours the person is eligible for. They
advise the Direct Payment team and they set up the Direct Payment using a
flat hourly rate depending on whether they choose to use Personal
Assistant or Agency, to provide the support. The financial assessment is
completed in line with fairer charging policy and is done via the Finance
department.

 4. With the above policies and documents in mind, please also provide any
other policies or practice guidance documents you feel are either
pivotal or complementary to understanding the above policies and
practice guidance documents.

There are no other policy documents available.

We supply this information based on your original request. If this is not
