Data Held On The PNC

Response to this request is long overdue. By law, under all circumstances, Home Office should have responded by now (details). You can complain by requesting an internal review.

Dear Home Office,

I have been informed that the responsibility of a persons criminal record now lies with you as the Home office as the NPIA has ceased to exist.

I would like to know what remedies are available to a person when completely false information is put onto the PNC by a Police Force. The force i am particularly referring to here is South Wales Police and have consulted with them and asked them for this information but they have been very uncooperative in getting to the bottom of this issue. I would like to know what measures the home office takes when the force that put this data onto the PNC refuses to take it off even when they cannot produce a shred of evidence to back up the legitimacy of the information on there.

Dear Home Office,

I have done everything that you have stated in your response, even contacting the Chief Constable Peter Vaughan through my MP. He states that it is not his responsibilty to oversee what goes on at PSD and the data protection unit. I have also contacted the commisioners office to address the issue with no success as they state i will have to prove that the data they hold about me on the PNC is false.

I dissagree that i should have to prove what South Wales Police put on the PNC is false when they apparently do not have to prove anything. Any data held on the PNC regarding a person should be backed up by evidence yet i have asked South Wales Police to produce any evidence that shows that what is contained on the PNC about me is correct and they refuse to give it to me. When i took them to task over where their source was, they told me it was Cardiff Crown Court, yet i have the case bundle from Cardiff Crown Court and everything from the trial has been destroyed conveniently enough, so the very data that would back up their claims if in fact it was true doesnt exist so i am being lied to. Why should i have an offence on my record that i never pleaded guilty to and in fact, never even had the opportunity to enter a plea to this charge. Why should South Wales Police be allowed to put anything on a persons record without any evidence from the courts relating to that particular offence??

So my point is, if the Chief Constable of South Wales Police wont intervene when criminal offences are happening under his watch then who will??
