Data Cleansing, Data Destruction , Data being ' Summarised ' by NHS

Information Commissioner's Office did not have the information requested.

Dear Information Commissioner’s Office,

Having attended a meeting of the Avon and Wiltshire Mental Health Partnership on 29 06 2016, the public were told all paper records relating to patients is being ' summarised ' and the original paper records held in files are being destroyed.
There has also been talk of ' data cleansing ' .

I have found this trust to have more than its fair share of ' issues ' on the internet, relating to records and data protection matters, and am MOST concerned to see the above processes are now taking place ?

As a long term patient of this trust, I am MOST concerned they may not be acting in total compliance with your requirements, and wonder if you can investigate what they are doing, and prevent the destruction of patients records until such time as you are wholly content with their actions ?

Would you please provide me with all policies and procedures and guidance you are aware of, that would allow or prevent this trust from destroying the total complete record, and instead write their own summary ?

Can you give me information about data cleansing please, that will wholly explain what is being done to any / all of my data held by this trust ?

I am concerned that many letters, emails, voice recordings and medical records and diagnosis' of mine, and other patients , may be destroyed - without our knowledge or consent and ask what guidance or regulation or Law you enforce to prevent this from happening.

Clearly such actions will cause me huge damage and distress, and have a negative effect on me , and other patients and their representatives when they realise this is going on ?

I trust where the ICO have carried out an inspection of this trust recently and found all is not entirely as it should be , you will take a close look at these matters ?

Before you advise me to do so, I have made a Subject Access Request under the Data Protection Act late in May 2016 , to include all of my medical records, as I believe I am entitled to do so as to see my CURRENT records ?

The request has been refused, as were two other requests made over the past three years.

Hence, I have not received the disclosures I am entitled to see for over three years now.
I ask you to help me by way of a ' reasonable adjustment ' as I am disabled.

 1. raised concerns about compliance by Avon & Wiltshire Mental Health
Partnership with the Data Protection Act 1998 (the DPA), and
 2. asked for information held by the ICO under the Freedom of Information
Act 2000 (the FOIA).

 
Concerns under the Data Protection Act 1998
 
Re a) we can confirm that a case has been set up for our Performance
Improvement Department to look at your data protection related concerns,
including your subject access request.
 
However, as the issues you have raised relate to your personal information
we cannot discuss this with you over the ‘WhatDoTheyKNow?’ website as this
is open to the public.
 
Because of this we strongly recommend that you contact us, either by
writing to us at the address below, or by email to [1][email address]
from your own private email account. 
 
We need you to provide us with a postal address or private email account
where we can contact you about the data protection issues you have raised,
and the reasonable adjustment you have referred to.  Please make sure you
include your name in your correspondence, and the name of the NHS Trust
you have raised concerns about so that we can link any new correspondence
to your existing case.   
 
If you do not provide us with a private postal or email address,
unfortunately we will not be able to contact you about your concerns, as
at the moment our only means of contacting you is via the WDTK website.

You have asked us to provide you with the following information:
 
“Would you please provide me with all policies and procedures and guidance
you are aware of, that would allow or prevent this trust from destroying
the total complete record, and instead write their own summary?

Can you give me information about data cleansing please, that will wholly
explain what is being done to any / all of my data held by this trust?

I am concerned that many letters, emails, voice recordings and medical
records and diagnosis' of mine, and other patients , may be destroyed -
without our knowledge or consent and ask what guidance or regulation or
Law you enforce to prevent this from happening.”

We have dealt with your request in accordance with your ‘right to know’
under section 1(1) of the Freedom of Information Act 2000 (FOIA), which
entitles you to be provided with any information ‘held’ by a public
authority, unless an appropriate exemption applies.
 
We should firstly explain that we do not hold any information that relates
to the requirements of this particular NHS Trust regarding the destruction
or cleansing of personal data.  However, we do have some more general
guidance available which you may find of help, or interest.

Not wishing to upset you, but I am unable to see the specific information I was asking for within the
numerous documents you kindly sent me - would you be kind enough to refresh your memory and take a close look at the main specific matters I was asking about , and see if more suitable and detailed information is available for you to provide please ?

May I also ask for a small piece of additional information which I cannot see within the information you have so far provided . When a public body , health , provides a disclosure of documents - what should their accompanying letter include ie: source of information, who it has been shared with and when , what has been removed or destroyed and the reasons why, an offer to explain the technical health details , has data cleansing taken place, have documents been summarised or edited, if the data disclosure is complete, specific documents or data that has been witheld and why , documents or parts of documents they have identified have gone missing . Should a Caldicott Guardian be accessible to a SAR applicant to answer specific questions - the role of the Caldicott Guardian to a SAR applicant with questions to ask ?

Thank you for your email of 16 August 2016, and please accept our
apologies for the delay in our reply.
 
As we explained in our previous response of 18 July, unfortunately we do
not hold any information, nor have we produced any specific advice or
guidance, on the issues of data retention and data cleansing within the
health sector. 
 
The links that we sent to you previously were more of an illustration of
the general advice and guidance the ICO has produced, either on data
protection issues relating to the health sector in general (as opposed to
the specific areas of interest to you), or specific advice and guidance on
data retention for all data controllers subject to the requirements of the
Data Protection Act 1998 (DPA), and not just those within the health
sector.
 
Turning to your second query, we understand you are also asking about the
requirements placed on a data controller when responding to a subject
access request under the DPA.
 
You have asked whether a data controller should include in their response
to a subject access request the following information (our response to
each query is shown in italics):
 
 

* The source of the information held

Under s7(1)(c)(2) a data subject is entitled to “… any information
available to the data controller as to the source of those data”.
 
 

* Who it has been shared with and when

Under s7(1)(b)(iii) a data subject is entitled to a description of “… the
recipients or classes of recipients to whom (the personal data) are or may
be disclosed”.
 
 

* What personal data has been removed or destroyed, and why

There is no specific requirement for a data controller to advise a data
subject whether their personal data has been removed or destroyed
 
 

* An offer to explain the technical health details

Section s8(2) confirms that “… where any of the information referred to in
section 7(1)(c)(i) is expressed in terms which are not intelligible
without explanation the copy must be accompanied by an explanation of
those terms”.
 
 

* Whether data cleansing has taken place

There is no specific requirement for a data controller to advise a data
subject whether any ‘data cleansing’ of their personal data has taken
place
 
 

* Whether any recorded personal data has been summarised or edited

There is no specific requirement for a data controller to advise a data
subject whether their personal data has been summarised or edited
 
 

* If the personal data provided is a complete record of all personal
data held

There is no specific requirement for a data controller to advise a data
subject whether the personal data they are entitled to under their right
of subject access is a complete record of all personal data held
 
 

* Confirm if any specific documents or personal data has been withheld,
and give reasons why

There is no specific requirement for a data controller to advise a data
subject whether any of their personal data has been withheld, nor is there
any requirement for a data controller to explain why any personal data may

We are not aware of there being any specific requirement for a data
controller to provide the services of a Caldicott Guardian, or other
advisor, to answer any questions the data subject may have about their
subject access request.  We understand that a Caldicott Guardian may be
invited by either the applicant or the data controller to provide advice
and answer specific questions, but there is no obligation to do so.
 
You may find it helpful to look at the The Caldicott Guardian Manual 2010,
published by the Department of Health, which sets out the role and
responsibilities of Caldicott Guardians, and is available at the following

the police.

Thank you for the further information, invaluable , that clarifies the position for me .

However , within your email to me on 18th July 2016, you did confirm you had set up a case to look into a non response to a SAR under DPA and needed my address etc to send some documents.
I telephoned the helpline whilst you were on holiday , and was told you had left the details of the lady who would be dealing with these matters in your absense.
The gentleman I spoke with was very helpful, and said he would send my contact details address etc to the person you named - but that was at least three weeks ago now and ive heard nothing since ?
May I ask you to please look into this matter for me, and to ensure the paperwork I need to use is sent to me as soon as possible now please ?

you about the concerns you raised with us under the Data Protection Act

One of my colleagues from our Performance Improvement Department wrote to

received your email of 16 August saying you hadn’t heard from us the same
letter was again sent by post to your home address on 18 August.

I am unable to alter the title you have attached to my email

You will see I made this FOI request on 02 07 2016, and had numerous contacts with you, and spoke with other staff in an attempt to be sent the necessary form to ask you for help in respect of an SAR under DPA made to the Avon and Wiltshire Mental Health Partnership. It was simply the form I needed and repeatedly asked for in writing and verbally on the phone since 02 07 2016.
The postal service has not failed me before, and I find it unlikely they have now ?
On Saturday 03 September, I eventually received a recorded delivery letter from Mrs Zoe Barker ( NOW RFA0636319 ) stating " Firstly I need to clarify that we are unable to look at matters which occurred more than three months ago. "
An enclosed compliment slip states " Please find enclosed copy of letter of 11 8 16 which Antonia Swann said you had not received " signed Z. Barker .
I feel I have been subjected to harsh and unfair treatment by ICO staff following my asking for the necessary form to be sent to me repeatedly as ICO was stating it was being sent - but it never arrived , and even the eventual recorded delivery letter did not enclose the form - just the letter dated 11 August ( received for the first time on 03 September ) giving a deadline that has now passed following the TWO MONTHS that I have needed to continually chase this up by email and phone calls in an attempt to get the form that has STILL not been sent to me.
Please advise me of your proposals to put this matter right, and PLEASE PLEASE PLEASE send me that form ?
May I again remind you of my vulnerability and disabilities - this bad experience has had a very negative effect on me.

of 11 August, and for the distress this delay has caused you, but we have
to reiterate the ‘WhatDoTheyKnow?’ website is not the appropriate forum to
discuss this issue with you.
 
We are of course willing to deal with, and discuss, your information
request under the Freedom of Information Act 2000 using this website.
 
However, we are not willing to discuss your private concerns under the
Data Protection Act 1998 via this website any longer. 
 
We will send you the form as requested, but in the meantime we strongly
recommend that you contact the Case Officer, Zoe Barker, directly and
privately.  This can be done by calling her on the phone number she gave
in her letter, by email to [1][email address] or in writing to the ICO

I know you have become ' sensitive ' to the fact that I have not received the form to use to ask you to investigate non compliance with a SAR.
Thank you for someone sending me some two weeks ago the details on how to complete the form and the information you need,
BUT STILL THE FORM HAS NOT BEEN SENT TO ME .
As my SAR request was made verbally under a ' reasonable adjustment ' in May 2016 , I believe I am now time barred from having the opportunity of having this matter looked at ?
Leaves a most unpleasant taste in my mouth treating the vulnerable and disabled in this way.
