Subject: FOI Response - FOI/PH&A2101

Dear Joanne Coe

RE: Freedom of Information Request: LD and MH teams information

Please find below and attached our response to your Freedom of Information
Request Ref: 2101

1.       It has been a number of years since we had separate LD and MH
Teams, the teams joined the older people's teams to become
multi-disciplinary geographical teams divided into Under 65s (18-64yrs)
and Over 65s.

2.       There is a First Response Team which is the 'front door' into
adult social care, it is the first port of call for service users etc.

3.       If you wish to contract with adult social care please contact our
contracts and commissioning department via their direct email:
[1][email address]

4.       With regards to team manager names etc. Section 40(2) of the FOIA
states that the personal information of a third party must not be
disclosed if to do so would contravene any of the data protection
principles.  ‘Personal data’ is defined under section 1(1) of the Data
Protection Act 1998 (the DPA) as data which relates to a living individual
who can be identified from that data, or from that data and other
information which is in the possession of the data controller or is likely
to come into the possession of the data controller.  Accordingly the names
and email addresses of staff and their job titles where that can identify
them fall under the definition of personal information.  The data
protection principle that is most likely to be relevant is the first
principle of the DPA which states that personal data must be processed
fairly and lawfully.  If the processing (in this case the disclosure)
would not be fair, then it would contravene the first DPA principle, and
the information is then exempt from disclosure under FOIA section 40(2).
The Council takes the following factors into account in deciding whether
disclosure is fair:

• whether the requested information is sensitive personal data;

• the consequences of disclosure;

• the data subject’s reasonable expectations of what would happen to their
personal data;

• the balance between the rights and freedoms of the data subject and the
legitimate interests of the public.

It would not be fair to disclose the requested information and it is
therefore exempt under section 40(2) of the FOIA however, I have attached
our senior management structure.

Kind Regards
