Dear Warwickshire County Council,

I would like to make a request for information pursuant to the Freedom of Information Act 2000 in relation to the Council's policies and internal guidance to staff on the subject: 'Data Breaches'. If there is any variation or differences across service area or department to my specific requests, please provide all copies relating to Children's Social Care & your Legal Department that you hold.

To assist you in completing my FOI, I have created a scenario:

A father with parental responsibility whose son is subject to a Child Protection Plan receives an email from the allocated social worker. Upon opening the attachment, he realise the child's mother was the intended recipient because the letter which is addressed to her contains her personal details such as her address. There are ongoing court proceedings where the mother has obtained an non-molestation order against the father due to the mother making a report to the police alleging the father assaulted her. The police are actively carrying out their investigation. The Judge made clear at the last hearing the father should not approach the mother or be seen in proximity to her and the judge included on the face of the Court Order that the mother's address must not be disclosed to the father. A copy of the court order was sent to the Local Authority, the father & the mother. As a result of the social worker including the wrong recipient in the 'to' section of her email, she has unintentionally committed a data breach and unintentionally not complied with the recent court order.

1) Please supply a proforma or a template copy of the form employees of Warwickshire County Council are required to fill out and complete when they first realise they have committed a data breach.

2) Please provide a copy of your policy relating to Data Breaches where it should contain when others such as HMCTS, ICO, Police should be contacted regarding a data breach and guidance on when this is likely to be necessary.

3) Please provide a copy of all documents that you hold containing any reference to the internal procedures the social worker would be expected to follow and may form part of her standard issued contract of employment or signed code of conduct.

4) In contrast to the above, please provide any material relating to Warwickshire County Council/its employees being the recipient of a data breach.
