Data associated with trespass on fire station land related to protests against Sheffield City Council's street tree felling programme.

Response to this request is long overdue. By law, under all circumstances, South Yorkshire Fire and Rescue Service should have responded by now (details). You can complain by requesting an internal review.

Dear South Yorkshire Fire and Rescue Service,

Please provide me with any and all data held and archived associated with Sheffield City Council/Amey felling trees adjacent to Rivelin Valley Road fire station.

I am particularly but not exclusively interested in correspondence with Laraine Manley, other council officers, their agents or South Yorkshire Police seeking to confirm that anyone on firestation land should be considered trespassing. The date of this correspondence is likely to be February/March 2018.

I refer you to information already in the public domain for reference - https://www.whatdotheyknow.com/request/5...

Many thanks in anticipation.
Yours faithfully,

Mr. Buxton

Dear Mr Buxton

Freedom of Information Request Reference No: FOIA 1735

Thank you for your email of 10/12/19 where you requested information
relating to tree felling near Rivelin fire station.  Your full request
followed by our response is as follows:

Please provide me with any and all data held and archived associated with
Sheffield City Council/Amey felling trees adjacent to Rivelin Valley Road
fire station.

I am particularly but not exclusively interested in correspondence with
Laraine Manley, other council officers, their agents or South Yorkshire
Police seeking to confirm that anyone on firestation land should be
considered trespassing.  The date of this correspondence is likely to be
February/March 2018.

I refer you to information already in the public domain for reference -
[1]https://urldefense.proofpoint.com/v2/url...

I can confirm that South Yorkshire Fire and Rescue (SYFR) holds one email
document, dated 14 March 2018, that was sent to Sheffield City Council in
relation to felling trees near Rivelin Fire Station, however this only
related to consideration of our business continuity plans of ensuring the
effectiveness of our emergency response.  Please find redacted copy of
email named ‘Redacted Email from SYFR to SCC for FOI 1735’.

Some of the information we are providing you has been redacted under
Section 40 of the FOIA as it is the personal information, this includes
staff names, partial email addresses, phone numbers and signatures.

Section 40(2) provides that personal data about third parties is exempt
information if one of the conditions set out in Section 40(3) is
satisfied.  Under the FOIA, disclosure of this information would breach
the fair processing principle contained in the General Data Protection
Regulations (GDPR), where it would be unfair to that person’s
confidentiality.  We have used the information Commissioners guidance
regarding third part data, see link:
https://ico.org.uk/media/1213/personal-i...

We believe this personal information would not routinely be available in
the public domain and this would be the expectation of these individuals
for the information not to be released.  Section 40 is an absolute
exemption and there is no requirement to carry out a public interest test.

Dear Emma,

Thank you for dealing with this request. Unfortunately, having examined FOI responses from other authorities, I am aware that SYFR is in possession of further information that should have been captured and published.

Please supply the remaining communications and any associated data held. I am particularly seeking but not exclusively, data associated with SCC and/or SYP soliciting SYFR to invoke trespass or in any other way refuse access to land. It is evident SYFR will be be in possession of such a document or similar, irrefutably sent by SCC along with a request that it be authorised by SYFR , this is referred to by Laraine Manly of SCC in communications now in the public domain.

Many thanks and kind regards,

Mr. Buxton
