The request was refused by British Broadcasting Corporation.

Dear British Broadcasting Corporation,
On Monday 27th January 2020 You aired a report into "killer smart motorways"
During this report you're reporter can be seen driving with their hands off the steering wheel and talking to camera and not paying due care and attention to the road ahead, thereby posing danger to other road users.

1) BBC Policy on driving and streaming / recording in vehicles being driven, and reporting. Specifically sections covering driving within highway code guidance and compliance with Road Traffic Act. Also BBC's driving at work / for work policy and any risk assessment conducted and confirmation the reporter has signed for and agreed to BBC's driving for work policy
2) Date, location of filming and registration number of vehicle used.
3) What the BBC propose to do with regards to their journalist driving dangerously committing at least 2 separate offences.
4) Confirmation that BBC have checked and confirmed that the reporter holds a full UK driving licence, the vehicle has full business insurance cover, and if required an MOT and has current vehicle excise duty in place, and confirmation of BBC's policy for checking driving documents for employees using their vehicles for business purposes.
5) Whether the BBC will assist the police service and provide any / all evidence required should the matter be reported to the police with regards to dangerous driving by the reporter.

Dear British Broadcasting Corporation,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of British Broadcasting Corporation's handling of my FOI request 'Dangerous Driving by reporter on Panorama'.

My initial request has been declined due to broadcasting exemption. While i can potentially accept that section 2 of my request MAY fall under this exemption none of the other queries do and are policy related which does not fall outside of the exemption.

Please review my request and provide the requested information

Dear Mr Bennett

As stated on your FOI response RFI20200132 the BBC does not offer an internal review when the information requested is not covered by the Act. If you disagree with our decision you can appeal to the Information Commissioner. Contact details are: Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, tel: 0303 123 1113 or see http://www.ico.org.uk

Please note that should the Information Commissioner’s Office decide that the Act does cover this information, exemptions under the Act might then apply.

Yours sincerely,
