Damaged Verges

Response to this request is long overdue. By law, under all circumstances, West Sussex County Council should have responded by now (details). You can complain by requesting an internal review.

Dear West Sussex County Council,
Does West Sussex County Council have a statutory obligation (having been given sound evidence) to prosecute offendersand recover costs of restitution who damage the grass verge and do not pay anything for the repair or restitution of said verge.
Can WSCC be sued for dereliction of duty in not pursuing offenders who damage verges as it should not fall on the shoulders of county taxpayers?

Dear Mr Lovell,

I apologise that you have not yet received a response to this request,
which was due to an administrative error. The response you should have
received is as follows:

 

I refer to your request dated 13th November 2020, which purports to be a
request for information held by the Authority, but which appears to be a
request for advice about the statutory responsibilities of the Authority
and the Authority's vulnerability to legal action if these
responsibilities are not fulfilled.

Your request falls outside the scope of the Act/Regulations and the
authority declines to respond to it.
