DAEDALUS / WATERFRONT : Lee-on-Solent Phase 1: Independent Dust Monitoring
Referring to above site and HCA’s Jeremy Herring email of 30 August 2017 timed 16.32, subject heading “Daedalus Dust & Rubble Management”. That email states:-
“In advance of our meeting on Friday I should let you know that the HCA has undertaken further independent air monitoring at the boundary of the Daedalus site in the same location as the Natta dust monitoring stations. This is as a direct result of Mrs Newsom’s concerns and is for reassurance purposes. I have sought to avoid it being confused with the statutory dust monitoring that Natta are undertaking.”
“These tests are generally carried out weekly and started end of July/beginning of August. They cover dust quantum, heavy metals, organics and asbestos. ..”
Relating to above Project works (December 2016 to present) and immediately quoted above please supply all air monitoring information to the current date. Also please give the name of the firm undertaking the work. For avoidance of doubt including all reports, full test results, monitoring exact locations from commencement onwards giving full dates. Please include PM10 and PM25 tests, levels and frequency.
Please state if there is no such information beyond the site boundary supplying the information and why not. If there are additional air monitoring tests to those quoted immediately above please also supply that information with the exception of the Natta information immediately below described.
As the Natta EAC% benchmark frequently quoted as a dust benchmark is only an indicative tool of dust discolouration (Dust Management Plan) as well as only relating to road Natta building July 2017 onwards, not to demolition works (January 2017 – May 2017) I do not request that NATTA information as it appears irrelevant and misleading.
For information airborne dust from this highly contaminated site continues (22 months so far). It is extremely fine thus likely breathed deep into lungs. Continued at the Eastern side is absence of watering down of the churned up dusty site other than rain.

I am writing to request an internal review of Homes England's handling of my FOI request 'DAEDALUS / Waterfront Air Monitoring Information'.
Please pass this FOI to the person responsible for conducting Internal Reviews because:-
My request is overdue.
My request has not been properly handled e.g. having been ‘processed’ solely under the EIR. A decision I reject and which has not been justified.
Information is wrongly, mainly unjustifiably withheld seeking in part to argue ‘at this time.’, as in “Homes England concluded the balance of the public interest test favours withholding the information at this time.” Quite the contrary is the case. Prompt disclosure and full transparency is very much in the public interest, to the public good, importantly in the interest of public health; far outweighing any possible reason for not disclosing at any time. Disclosure should be at the very earliest opportunity. Dust exposure has(is) occurred over 23 months to people, a museum, businesses, thousands of residents many sharing site boundaries, some highly vulnerable to the unmitigated development site dust.
This 84ha windy, coastal, flat site forms part of Daedalus (ex MoD airbase). It is on the UK Radioactive Waste Inventory, specifically Waste Stream 7S01 due to Radium 226 soil contamination. Listed in Homes England's Land Quality Statement are many other dangerous contaminants e.g. surface fibre asbestos, heavy metals, PAHs, TPHs. Residents are classified as “High Risk Receptors” by Homes England due to the site’s dust risks posed to them and their close proximity to the site. Similarly, due to the site’s extensive range of identified soil contaminants the site is designated ‘High Risk’. Airborne dust is in all probability polluted by the soil’s identified wide range of recognized carcinogenic contaminants. The information requested refers to the dust producing development works (inc. demolition) to build 220 homes are due to continue for considerable years. So full disclosure is sought, essential to inform implementation of proper practice: which knowledge hopefully will help ensure risks are reduced to the very minimum. Also to help early diagnosis and treatment of illnesses caused by inhalation and contact with contaminated airborne dust.
Without explanation to what it applies, mention is of Regulation 12(3). IF referring to the several black blocks at Annex A. that usage/explanation is rejected as it appears to seek to hide authorship of a scientific report. Authorship disclosure should be made. Is sought to enable verification of its professional standing. Noting Annex A’s frequent use of ‘Please Note: This method is not covered by our UKAS accreditation’ authorship verification is important and justifiably sought to evaluate status of given and hopefully yet to be provided information.
12(5)(6) is mentioned without explanation as to what. All given withholding reasons are rejected. I did not request financial information. Notwithstanding, fee, commercial/industrial information is mentioned as withholding reasons. The project is a one off, unusual in nature thus surely any such argument would not apply to this publicly owned land. Such argument surely fails with regard to ‘future agreements’ (3rd bullet). Disclosure of the information requested can only be to the public good; in the public interest and health; in the interests of transparency. It is believed all have a legal right to breathe safe air and to know what is in the air inhaled. Homes England has not given proper weight to disclosure including to that it quotes “..to promote transparency and accountability of public authorities to enable greater public awareness and understanding of environmental matters.”
Annex A, an Air Quality Monitoring report, is the sole response to my request. I believe Annex A has wrongly had withheld considerable information from it although that is not admitted. It is likely c.53 pages remains to be supplied but is withheld of important information re the air monitoring results of airborne contaminants and PM particulate levels. Perhaps the core information requested.
Homes England confirms the information requested exists. As Homes England’s email stated and quoted in my request notes, tests are ‘generally carried out weekly’ .. ‘They cover dust quantum, heavy metals, organics and asbestos. …’ There is NO INFORMATION regarding asbestos. I object to the withholding of those and other test results especially that re asbestos which Homes England’s own Land Quality Statements identify as site wide, at ground surface level. Asbestos fibres which are easily airborne, inhaled and are listed on site warning notices. Asbestos is a known cancer cause.
Annex A, at ‘Aims’ states “In addition, since the aim of the exercise is also to assess exposure to neighbours to the site, ..” As Homes England’s response to me supplied not a single assessment re neighbours that information has obviously been silently removed. Such removal cannot be justified, is objected to. I specifically requested that information. Amongst specific air monitoring information asked for, I requested information beyond the site boundary; plus if there was none an explanation of why not. Likely surely removed too rendering the sparse information supplied largely useless, are maps showing the Sampling Locations. Thus photos, alphabetical, numerical ‘Locations’ could be anywhere.
Information requested, still requested, is confirmed as existing but is not supplied. Some reasons for disclosure are outlined above. Environmental Information Regulations 2004 Part 3 Reg. 12(2) states ‘A public authority shall apply a presumption in favour of disclosure.’ Homes England waters that down in stating “Homes England accepts there are some public interest in disclosing the information to promote transparency and accountability of public authorities to enable greater public awareness and understanding of environmental matters.” For removal of doubt of legitimate need for prompt disclosure of all the requested information so as to lessen health risks I refer to, see following World Health Organization document: http://www.who.int/occupational_health/p... Dear Reader, Can I suggest that if you have not, click on the button which says 'show all attachments' beneath the attachments shown. Then you can read the Annex A to which I refer. This development is a nightmare. (Had I an inkling of what was to come I would have objected to the planning application.)
Demolition works of c. 20 + asbestos ridden buildings, were (with only a 2 wk exception) carried out Jan-May with hardly any watering down. Only a single hose too short to reach the upper floors was used.
Instead of the local authority producing a Dust Management Plan in place prior to demolition works start, it agreed to a road contractor writing it 2 months post demolition end. The road builder assumed ownership of resultant stockpiles of demolition material. Dust everywhere inside/over homes. My black car turned white in 1.5 hrs from white powered dust. Dust Management Plan had stripped out most of minimal protection measures, eg proper watering down, coverings. All agreed to by Homes England (Homes & Communities Agency) as then was in order to save money. Yes, both Environmental Health + Planning were informed by me + countless others. The future/new homes ? Homes from Hell perhaps?

My request for an internal review was as explained largely due to the withholding of considerable information regarding air monitoring, the full results/reports etc. For example, where are the results concerning asbestos ? The Internal Review has not responded on this matter and I now ask that this oversight be properly, quickly reviewed and all the requested information supplied: it has been confirmed additional information exists. Annex A itself appears incomplete,
I did not request any fee information nor company information about which Homes England's response has much to say.
I do not accept the lengthy reasons for the qualifications and identity of Annex A to be withheld. According to a Homes England FOI supplied email, the reason the tests were carried out in the first place was to re-assure myself and presumably the many other deeply concerned residents. Or is it such bad news it is being hidden ? I do not believe that PM levels are not available.
Looking forward to receiving the missing information without delay as I am about to refer this to the Information Commissioner.

Whilst some information was supplied (overdue) because information has been withheld I have complained to the Information Commissioner's Office re delay and the withholding of information of interest to both neighbouring, local and of public health.
Thousands of us now into 3rd year of being covered in site dust, reliant ONLY on rain/snow for damping ground down. Homes England + its builder partner Wates now for 2nd time creating more stockpiles. 5m high piles of fine site soil + concrete slabs. Council Planners did not put a Condition to 'preclude' stockpiles so tell me no breach of condition. More worry as no requested Verification nor Validation documents have been provided to prove the extensive range of contaminants have been remediated from ground including Land Qual. identified radioactive hotspots. So far only shifting around on site of soils appears to have happened. So not just fine airborne dust but sadly in all probability highly contaminated airborne dust. Don't think many locals would be interested in paying £225k + for a Daedalus Village / or live in a Radian Homes house on that. Sales brochure = "a breath of fresh air".
Seems this all result of a Government policy to spread 'the liability'.
