Dear Mr Elibank

I am writing in response to your request for information received by the House of Lords administration on 28 October.

The administration holds information relevant to your request. Copies of emails sent between the administration and the House of Commons together with any associated internal correspondence or documents are attached to this email. You will note that some information relating to the contact details for House of Lords staff have been redacted. This is because this information constitutes personal data, the disclosure of which would amount to unfair processing and consequently a breach of the first data protection principle. This information is therefore exempt from disclosure under section 40(2) of the Freedom of Information Act 2000 (“the 2000 Act”). In reaching this view we have taken into account the expectations of administration staff. We believe many members of House of Lords administration staff particularly those in less senior positions with no public facing role, will reasonably not expect their contact details to be placed into the public domain.

In addition, following consultation with the House of Commons we have also removed contact details as well as the names and contact details of less senior members of their staff. This information once constitutes personal data and disclosure of which would breach the first data protection principle. In reaching this decision we were obliged to take into account the reasonable expectations of House of Commons staff.

The administration also holds a small amount of information relating to briefing material provided to the Lord Chairman in preparation for his response to the oral question. This information is exempt information by virtue of section 34 (Parliamentary privilege) of the Freedom of Information Act 2000 (the “2000 Act”) because exemption from section 1(1)(b) is required for the purpose of avoiding an infringement of the privileges of this House.

I attach a copy of a certificate signed by the Clerk of the Parliaments for the purposes of section 34 of the 2000 Act. Please let me know if you would like a hard copy of the certificate.

Section 50 of the 2000 Act provides that any person may apply to the Information Commissioner for a decision whether, in any specified respect, a request for information made by the complainant to a public authority has been dealt with in accordance with the requirements of Part I of the Act. In this context you should bear in mind that under section 2(3) the exemption conferred by section 34 is an absolute exemption, and your attention is also drawn to the terms of section 34(3).

However, you may, if dissatisfied with the treatment of your request for information, other than the information covered by section 34, ask the House of Lords to conduct an internal review. Arrangements will be made for someone who has not been involved in dealing with your request to conduct an internal review. Our aim is to complete internal reviews within 20 working days.
