Dear Mr Elibank,
Thank you for your request for information which is copied below.
The information held by the House of Commons in respect of your request
which has not been provided to you by the House of Lords or the Transport
for London is attached.
Details of staff and names of staff who are not senior officials in public
facing roles have been removed. This information is exempt by virtue of
section 40 (2) of the Freedom of Information Act 2000 (the exemption for
personal information), as disclosure of this information to the public
generally, in the House’s view, would not be consistent with data
protection principles in the Data Protection Act 1998 (DPA). This is an
absolute exemption and the public interest test does not apply.
Some of the information within the scope of your request which relates to
briefing material provided to the Lord Chairman in preparation for his
response to the oral question is also held by the House of Commons,
however, it is subject to Parliamentary privilege. This information is
exempt under section 34(1) of the Freedom of Information Act (exemption
required for the purposes of avoiding an infringement of the privileges of
either House). The exemption applies in order to avoid an infringement of
the privileges of the House of Lords. This is an absolute exemption and
the public interest test does not apply. I am afraid I must therefore
refuse your request for this information.
I attach a copy of a certificate signed by the Clerk of the Parliaments
for the purposes of section 34 of the 2000 Act.
You may, if dissatisfied with the treatment of your request for
information, other than the information covered by section 34, ask the
House of Commons to conduct an internal review of this decision. Requests
for internal review should be addressed to: Freedom of Information
Officer, Department of Resources, House of Commons London SW1 OAA or
[1][House of Commons request email] . Please ensure that you specify the nature
of your complaint and any arguments or points that you wish to make.
If you remain dissatisfied, you may appeal to the Information Commissioner
at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.
Yours sincerely
Bob Castle
