Thank you for your e-mail dated 21 June 2024, requesting information from
the Planning Inspectorate.
 
You requested a list of appeal cases (including reference numbers and the
number of dwellings applied for) that have used the terms "self build" ,
"custom build", "self-build" or "custom-build" case insensitive in either:
 
1. The description of the application
2. The decision notice
3. Any other searchable and public part of the appeal text
 
We would advise that we are unable to provide you with the information
specified in your Freedom of Information (FOI) request, in its current
form, for the reasons below.
 
Section 12 of the Freedom of Information Act 2000 allows a public
authority to refuse a request where that request is 'manifestly
unreasonable'.
 
We do not contend that your request is unreasonable in itself, in either
context or content in its current form. However, the exception to
disclosure covers situations where the diversion of resources from other
priority tasks is considered unreasonable, as well as where the cost to
the public authority is considered unreasonable.
 
Regarding searches for the terms you have specified in decision notices
(Point 2), we would not be expected to review LPA Decision Notices under
FOI as these documents are primarily held by Council’s and are already in
the public domain for all to view.
 
This aside, this aspect of your request would require manually reviewing
the LPA’s Decision Notice for all appeals involving dwellings, that are
held in our database.
 
It would involve having to manually review thousands of results on a
case-by-case basis and would, in all likelihood, be in excess of the
appropriate limit (of £600 or 24 hours work) stipulated in the Freedom of
Information Act (or considered manifestly unreasonable in respect of the
Environmental Information Regulations 2004).
 
Similarly, regarding searching these terms in public parts of appeal texts
(Point 3), although this information may be held on our database, it is
not automatically identifiable. To search the appeals database for the
keywords provided and review the hits returned would involve having to
manually review thousands of results on a case-by-case basis which would
again likely exceed the above-mentioned limit.
 
We can search our database for the description of the applications for
appeals involving dwellings that use the terms you have described (Point
1).  However, in its current form, your request would again likely exceed
the costs limit.
 
If you would be minded to refine your request to a more specific period of
time (for example, all appeals relating to dwellings using these terms
submitted in the past 2 years), it is likely that our Statistics Team
would be able to provide this information to you.
