Can you please let me know the income or loss from the Curzon cinema for 2015/16 financial year and the 2016/17 financial year.

If you do not know this information for 2016/17 please provide the figure from the management accounts.

Can you please detail all of the costs, including any licensing arrangements with Curzon, staff costs for marketing and ticket sales, expected for the 2017/18 year.

I am writing in response to your Freedom of Information request in which you asked for profit/loss figures and details of our financial arrangements with Curzon Cinema.

Goldsmiths considers the requested information to be exempt from disclosure under section 43(2) of the FOI Act. Section 43(2) states;

(2) Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it)

The Curzon cinema at Goldsmiths faces competition for cinema-goers from a number of commercial cinema operators in local areas such as Greenwich and Peckham. Disclosure of the information you seek would provide an insight into our business strategy and performance and would be advantageous to them to and therefore detrimental to our commercial interests.

Section 43(2) is a qualified exemption. This means we are required to consider whether it is in the public interest to apply the exemption.

While we recognise that there may be some public interest in transparency in how a body in receipt of public funds organises its business affairs, we consider that it is outweighed by the public interest in there being fair competition in the running of cinemas and the University's ability to maximise its revenues from participating in this enterprise.

Dear Goldsmiths, University of London,

I am writing to request an internal review of Goldsmiths, University of London's handling of my FOI request 'Curzon Cinema at Goldsmiths'.

Running a cinema is not a core activity of a public body such as a university. Other providers already existed and there is a public interest in explaining its financial position.

Goldsmiths College is a public body, enjoying a range of benefits not available to commercial providers elsewhere.

It is not clear how the process concluded that it was not in the public interest, given Goldsmiths is a public body and the "competition" are private providers that already existed. If Goldsmiths is wishing to use its position as a public body to run a commercial activity, and is losing money - the public should be able to see the extent to which this is happening. The Act makes clear there is accountability with how public money is spent - and there should be disclosure about its financial performance.

The public should be able to see the performance of the cinema - is it making money? How much? Is it losing money? How much? How many people use it? Are they students or members of the local community?

There appears to be no analysis of who the customers are, and there is no assessment provided to demonstrate it would prejudice the commercial interests of the university. As part of your internal review, I would suggest you look at the process for making this judgement - as there appears to be no analysis provided about the benefits of making the disclosure.
