The FOI Act obliges us to respond to requests promptly and in any case no
later than 20 working days after receiving your request. We must consider

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held.  The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held.  Where exemptions are
relied upon Section 17 of FOIA requires that we provide the applicant with
a notice which: a) states that fact b) specifies the exemption(s) in
question and c) states (if that would not otherwise be apparent) why the
exemption applies.

 

In respect of your enquiry:

Having completed enquiries within Essex Police and in respect of Section
1(1)(a), Essex Police does hold information relating to your request.
Under Section 1(1)(b) Essex Police can provide a partial disclosure,  the
attached is a list off all overt Officers within the force above the rank
of Chief Inspector in relation to your FOI.

 

No further disclosure will be provided by virtue of the following
exemptions

 

Section 21 – Information reasonably accessible by other means

Section 31 (1)(a) Law Enforcement

Section 38(1)(a) & (b) Health and Safety

Section 40(2) (3a) Personal Information

 

 

In respect of many officers Section 21 – Information reasonably accessible
by other means applies – [1]https://www.essex.police.uk/, find your area –
allows submissions of areas and further details regarding officers within
the ‘your team’ tab.

 

With regard to all other officers in the force, [2]ICO guidance provides
information on the reasonable expectations of the individual concerning
personal information being disclosed. It states:

 

“It is reasonable to expect that you disclose more information about
senior public authority employees than more junior ones. Senior employees
should expect their posts to carry a greater level of accountability,
since they are likely to be responsible for major policy decisions and the
expenditure of public funds. For example, a junior employee who is not
accountable for their submissions to a senior government minister has no
expectation that their name will be disclosed in response to an FOI
request. Decision notice [3]FER0409841 upholds this stance.

 

However, the terms ‘senior’ and ‘junior’ are relative. It is not possible
to set an absolute level across the public sector below which personal
information is not released. It is always necessary to consider the nature
of the information and the responsibilities of the employee in question.

 

It may also be fair to release more information about employees who are
not senior managers but who represent your organisation to the outside
world, as a spokesperson or at meetings with other bodies. This implies
that the employee has some responsibility for explaining the policies or
actions of your organisation. However, it does not apply simply because an
employee deals with enquiries from the public or sends out material
produced by others.”

 

We believe that officers at the rank of Chief Inspector or above would
reasonably expect to have information disclosed. We therefore feel it is
reasonable to disclose full names, collar numbers and ranks for overt
officers within the force above the rank of Chief Inspector. No further
information

 

No further information will be provided by virtue of Section 40(2)(3) and
Section 31 and 38 of the FOI Act.

 

Section 40

S40  Personal Information S40(2) applies to third party personal data. 
This would not be released under the Freedom of Information Act where the
release would breach the data protection principles contained within the
Data Protection Act.   In this case,

s40(2) has been applied together with the condition in section 40(3)(a) 
This is because any disclosure of the redacted information would breach
the first data protection principle, which states that personal data shall
be processed lawfully, fairly and in a transparent manner in relation to
individuals. This is an absolute exemption and there is no requirement to
apply public interest test.

 

Section 31 and 38 are prejudice based qualified exemption and there is a
requirement to articulate the harm that would be caused in disclosing
information.

Overall harm for the NCND

Any release under the Freedom of Information Act is a disclosure to the
world, not just to the individual making the request.  The public expect
police forces and other law enforcement agencies to use all powers and
tactics available to prevent and detect crime or disorder and maintain
public safety. To disclose details of all Officers could subsequently harm
the ability of the police service to protect the public it serves and
could prejudice its ability to perform core functions. To confirm or deny
information such as the disclosure of officer names and roles as if they
are covert, undercover or operationally sensitive would substantially
impact the ability of the authority to collect reliable and accurate
intelligence and could undermine the security of the national
infrastructure.

 

Section 31 – Law Enforcement

Factors favouring complying with Section 1(1)(a) confirming that
information is held

Confirming or denying that any information exists relevant to this request
would lead to a better informed public.  Confirmation that information
exists relevant to this request would lead to a better informed public
regarding the staffing and roles within the police force demonstrating
resourcing and experience within the force. The level of detail
demonstrates complete openness and transparency.

 

Factors against complying with Section 1(1)(a) neither confirming nor
denying that information is held

The Police Service will never disclose information which could identify
investigative activity and therefore undermine their investigations. By
disclosing information to the public could dissuade officers from taking
covert, undercover or sensitive roles. This would cause subsequent harm to
the Police Service’s ability to protect the public it serves and could
prejudice its ability to perform core functions prevent or detect crime
and increase harm to the general public.

 

Section 38 (2)

Factors favouring complying with Section 1(1)(a) confirming information is
held

 

Confirmation of whether information is or isn’t held would provide
reassurance to the general public that police forces act in a transparent
manner demonstrating the level and experience of staffing within the force
is at adequate levels to actively prevent and detect crime or disorder and
protect the community. This awareness could be used to improve any public
consultations/debates in relation to this subject.

 

Factors against complying with Section 1(1)(a) confirming or denying that
information is held

 

Confirming or denying this information exists could lead to the loss of
public confidence in ability to protect the wellbeing of the community.

 

Disclosure of this information may lead to the identification of Police
Officers who by the nature of the role they perform may result in them
being targeted and at risk of harm. Additionally, not only is there a
personal risk to those officers, who may be vulnerable to harm but also to
associates of those individuals. If compromised there will be an increased
harm to the public at large.

 

Balancing Test    

The points above highlight the merits of confirming or denying the
requested information exists. The Police Service is charged with enforcing
the law, preventing and detecting crime and protecting the communities we
serve. As part of that policing purpose, information is gathered which can
be highly sensitive relating to high profile investigative
activity.  Officers assist with criminal investigations and the effective
delivery of law enforcement, The Police service is tasked with protecting
the community we serve, weakening the mechanisms used to monitor any type
of criminal activity, and specifically terrorist activity would place the
security of the country at an increased level of danger. 

 

In addition, any disclosure by Essex Police that places the security of
the country at risk, no matter how generic, would undermine any trust or
confidence individuals have in us, therefore, at this moment in time it is
our opinion that for these issues the balance test favours withholding of
any further information.

 

No inference can be drawn from this refusal that information is or isn’t
held.
