Dear Rev’s & Ben’s FOI,

 

I have reminded your service about very overdue FOI already, but this week
alone I have received 5 emails from this requestor chasing his response.

The due date was 1^st December and as far as I can see from Northgate and
EDRMS there has been no communication with him apart from the initial
acknowledgement email.  

 

Could you please either provide the information he wants or contact him to
explain why there is a delay.

 

I have already informed him that I can’t help at this stage.

 

Any future emails I receive from him will be forwarded to the Rev’s FOI
mailbox.

Further to your request for a review to the response provided to your
Freedom if Information request – 851820 (Internal Review reference –
938102), I can now confirm that that this has been undertaken by an
independent officer and the outcome is as follows:-

 

The findings were that the request was dealt with correctly in terms of
the information to be released or withheld.  However, there were some
points identified which it is acknowledged should have been made clearer
to you.

 

Firstly, it is acknowledged that it was not clear as to why only certain
information was provided to you. The response should have specified that
only information relating to limited companies could be provided, as other
information relating to private individuals would be withheld under
section 40 (2) (Personal Information) of the Freedom of Information Act.
Section 40 (2) applies where disclosure of third party personal data would
breach any of the Data Protection principles.  The Council has a legal
requirement under the Data Protection Act (1998) to process data fairly
and lawfully. The Council considers that releasing third party personal
information would be unfair and as such a disclosure that would breach
section one of the DPA.

 

Secondly, the response could have been dealt with in a more timely manner
and an apology given, along with reasons for a delay.

resolve the matter to your satisfaction, you have the right to apply
