Response to this request is long overdue. By law, under all circumstances, Department for Work and Pensions should have responded by now (details). You can complain by requesting an internal review.

Dear Sir or Madam,

From the DWP Subject Access Response Guide (SARG) obtained under the FoI request http://www.whatdotheyknow.com/request/su... made 18 November 2008.

"Transfer of SAR to correct DPO

125 When a response is required only from another Business Unit, the DPO who initially received the SAR should send it by courier to the appropriate DPO in the other BU. Every effort should be made to ensure that the SAR is sent to the correct location – if necessary the DPO should contact
the receiving Business Unit to establish the correct destination or check the current DPO list."

In your response dated 19 December 2008 the DWP stated;

"As the SARG is internal guidance which is available to staff via our internal website, you will therefore find that certain links within the document do not work, as they link to this internal website to which you do not have access. If you would like any of the linked documents,
please let us know and we will happily provide copies."

Please provide the Information held under the Link at paragraph 125 of SARG and highlighted in the provided PDF as "current DPO list".

Please redact employees names as per policy and contract but do provide the relevant Offices locations and contact addresses, the nature of Data processed or potentially held at each site for which the Data Protection Officer (DPO) would be responsible to provide under a Subject Access Request and required to retrieve and send in the fulfilment of the Subject Access Provisions of the Data Protection Act 1998 to the person issuing a Subject Access Request.

Dear DWP Adelphi Freedom-of-Information-Request,

Thank you for your response which is incomplete.

First, I note that the list of Data Protection Officers provided omits the required contact details of any officer associated with Caxton House, London SW1H 9DA, being the headquarters of the DWP.

Could you please provide this by return and within the required time limits of the original Freedom Of Information Access Request.

Am I to take it that this office of the DWP has no such officer or person required to act or respond to A Subject Access Request (SAR) issued under section 7 of the Data protection Act 1998, or that in response to such a SAR any and all data in the possession of the DWP at Caxton House is to not be provided in the response because no one within the DWP knows to ask for it, or who to contact at Caxton House?

The Original Request is most clear where it states;

"Please redact employees names as per policy and contract but do provide the relevant Offices locations and contact addresses, the nature of Data processed or potentially held at each site for which the Data Protection Officer (DPO) would be responsible to provide under a Subject Access Request and required to retrieve and send in the fulfilment of the Subject Access Provisions of the Data Protection Act 1998 to the person issuing a Subject Access Request."

You have provided the redacted information concerning the locations of offices, but you have omitted all the other requested information.

I am therefore obliged to notify you that you have again failed to comply with the Original FOI request.

Please comply fully with the original request of 5 February 2009 within the time limits set out for compliance.
