Can you please provide me with the information in response to the questions below.

1) Please name each of the current members of BCC’s Chief Officers Management Team, their respective current job title and supply a copy of their current job description and person specification for the role they currently undertake and their current level of remuneration.

2) Clarify which of the above members of the COMT are currently employed on a permanent/temporary/interim/agency contract and the reason for the choice of this type of employment relationship

3) Clarify which method of Belfast City Councils approved recruitment and selection processes/procedures were used to fill the current afore mentioned Chief Officer Management Team positions, which personnel were involved in the final selection decisions and subsequent approval of appointment ( designation only required)In addition please clarify how these appointment decisions and associated processes utilised were in line with:

a) the guidance and principles as set out by the Local Government Staff Commission for the effective and lawful management of the potential staffing issues associated with the recent Review of Public Administration across all councils throughout Northern Ireland and;

b) their general guidance on the staffing implications of organisation development and change.

4) Clarify which personnel had ultimate responsibility for the final approval of these appointments, whether permanent, temporary or interim/agency

5) Of those current members of the COMT whom you have clarified as being employed to their current positions on a non-permanent contractual basis please clarify when this employment within BCC commenced, the anticipated future duration of this contract , how the contract is reviewed , by whom and how often

6) Of those current members of the COMT whom you have identified as being employed presently on a temp/interim/agency basis please supply details of which BCC approved recruitment and selection procedures will be used to fill these posts on a permanent basis

7) Provide a breakdown in relation to the BCC approved recruitment and selection processes which were identified as being used to appoint each current post holder of the COMT, (irrespective of the type of contract they are currently employed under) by number of applicants; number of shortlisted applicants; number attending each stage of the selection process ( ie. Assessment centre/interview /2nd interview etc) by personal religious affiliation and gender.

8) Please clarify the process by which the current COMT job descriptions and personnel specifications were designed ( either as new roles or as amended from the previous Belfast City Council Director roles pre April 2015), job evaluated and approved and which personnel ( designation only required) were involved in this process.

Thank-you for your reply in response to the FOI I submitted on 30/07/16 and for clarifying that you do hold the information I requested.

As per your letter I would ask Belfast City Council to formally review its decision regarding the information it has published to me.

It is my understanding after speaking to a representative from the Information Commissioner office NI ,that, in order to make the review request meaningful I should ask for clarification based on the information you provided and should identify specifically where I feel a review is justified.

Therefore please see below regarding my appeal request:

1. Remuneration of each member of BCC CMT. I would request that BCC review their decision to only publish wide pay bands and not specific individual salaries. Currently it is common practice for councils in the rest of the UK to publish specific salary details of the senior management team. New guidance (contained within the Code of Recommended Practice for Local Authorities on Data Transparency )which includes key principles as recommended by the Dept for Communities and Local Government , specifically states under the heading Pay and Grading Structure, that at a minimum the salary details for the most senior staff should be provided in £5000 salary bands. Whilst the IC acknowledges in this document the fact that the recommended CoP does not apply to local authorities in NI he strongly recommends that they follow the guidance as set out in this document which supports the model publication scheme. The IC also points out that if the information relates to the individuals in their professional/public role rather than their private life then it is reasonable to expect that publishing information would be in the interests of meeting the overriding principle of the Act which is to promote transparency .

2. Please be more specific in your response to my request for information regarding the reason for the type of contract/employment relationship chosen., rather than only the committee who approved the process. For example upon what rationale/opinions did they approve the decision? To answer this request in as transparent a manner as possible, please provide a copy of any summary papers or reports containing the details that were presented to each committee enabling them to make their decision in a fair and equitable manner regarding each of these decisions with the names of the reporting officers contained within.

3. Please be more specific in your response to my request for information regarding how the recruitment and selection and appointment decisions were in line with points 3 and 3a and 3b as outlined in your response. For example how were the processes used in line with 44a code of prodecure for securing fair and equal consideration of applications to councils by persons seeking to be employed by them as officers and fair and equal treatment of person who are so employed; were the Director posts identified as unchanged or minimally altered/ vacancies or new or substantially new posts

4. Please could you clarify who were the members of the Local Government Joint Reform at the time the advice was provided, what specific advice was provided by the Local Government Joint Reform Forum in relation to the recruitment of the director of HR/OD and the Director of Finance, the date it was provided and the name and designation of the person/those persons responsible for providing this advice.

5. Please be more specific in relation to which personnel were involved in the selection and final appointment process of each post. As you have specified no one person has overall authority so please could you share with me the names, job titles of each of the constituents of the selection/interview panels/ assessment centres etc, along with which members of the relevant Committee (as outlined by yourselves as approving each appointment ) were present on the dates in question in relation to approving the recruitment and selection processes and final subsequent appointment for each post. Recent advice and guidance has stated that specific details regarding senior members of public authorities with regard to the discharge of their responsibility for appointment decisions, policy decisions and the use of public money should be strongly considered.

6. I accept that in relation to religious affiliation that this figure must be provided in composite format but please could you provide specific figures as contained within my initial request in relation to a breakdown by gender at each stage of each of the 7 recruitment and selection processes you have identified in table 2 of your response, along with dates of each of the key stages of the process. In addition please clarify why a total of only 6 appointments are highlighted in your response under point seven when in table 2 you have detailed 7 recruitment processes?

7. Please clarify what redesignation is/means in relation to the appointment process within BCC as outlined in your response and why it was used in the appointment process for the posts as identified by yourself in your response to my initial request. Ie Director of Organisational Development and town solicitor

8. Please provide contact details for the person/s who was/were in charge of the recruitment and selection process of the Director of Organisational Development within the LGSC and the person/persons at the LGA who carried out the job evaluation of each post and undertook the design of the Director of OD job description, along with the dates these public services were provided to BCC
