Dear Corby Borough Council,

In accordance with the Freedom of Information Act 2000, and subject to section 40(2) on personal data, could you provide me with the following current business rates account data for your local authority.

Please note that I do not require any personal data or data in respect of sole traders or partnerships. This is a request for information in respect of companies, charities, councils and other organisations only.

This request is only in respect of businesses that are deemed to be occupied for business rates purposes. Do not provide any information is respect of properties that are considered to be empty or unoccupied for business rates purposes.

The provision of this information is in the public interest as your authority is currently awarding grants and discounts worth tens of millions of pounds to ratepayers. Nationally, councils are awarding grants and discounts worth tens of billions of pounds to companies and organisations, some of which have turnovers of billions of pounds. Some of these ratepayers may previously have been reported as engaging in activities that aim to reduce the amount of tax that they are liable to pay. As such, I believe that the provision of this information is in the interest of taxpayers and the wider public.

Dear Madam

As detailed on the website under the link provided, please note that with
regards to providing liable party name, under Section 21 – information
already reasonably accessible - of the Freedom of Information Act 2000,
please be advised that Primary Liable Party details are no longer provided
within this report.  A decision was made that, even though we hold this
information, as it is available within the public domain, it would no
longer be reported.  This exemption is absolute and is not subject to a
public interest test.

For assistance:  if you carry out a search of the address using your
relevant search engine, it should provide you with company details. 

However, please note that if the primary liable party is a private
individual or a sole trader, information will not be available either via
the public domain or Corby Borough Council, as this is exempt under
Section 40(2) of the Freedom of Information Act 2000 - Data Protection. 
This is because the information constitutes personal data as defined by
the Data Protection Act 2018 and such disclosure would be likely to break
principle 1 of the Act (Fair and Lawful Processing).  This exemption
is absolute and is not subject to a public interest test. 

With reference to occupied relief entitlement, please note that Corby
Borough Council will no longer be publishing relief details on our website
under Section 31(1)a of the Freedom of Information Act 2000 - the
prevention or detection of crime, as the release of the information is
likely to prejudice various law enforcement purposes, including preventing
crime and administering justice.  The Council cannot see any public
accountability or transparency arguments that enables it to fully consider
the public interest arguments for disclosing this information.  Therefore,
there is no likely benefit to the wider public in releasing this
information.

However, please be advised that information is available on request via a
Freedom of Information Request, which will now be forwarded to the
appropriate department for response.  A response will be provided within
20 working days with regards to this part of your request.
