I would also like to receive a copy of the complete current local authority Gifts and Hospitality Registers for all elected politicians in a machine-readable spreadsheet format, including any data that may not be published on your website.

If you hold historical records of gifts or hospitality received for current and former elected politicians I would be grateful if you could also supply them.

Lastly, if you hold a separate register of interests that records those declared at meetings, please also supply that register in a machine-readable spreadsheet format. Again, if you hold historical records of declarations that may not be published on your website, please supply details.

I would prefer not to receive the requested information in pdf format files.

If the requested information is published as open data, please could you supply the location where this data can be found.

1)      I would like to receive a copy of the complete current local
authority Register of Interest for all elected politicians in a
machine-readable spreadsheet format such as a CSV file, including any
additional information that may not be published on your website.

Crawley Borough Council’s Response

The Council’s Register of Councillor Interests is accessible via this
[3]link. You should select the name of an individual Councillor and you
will be able to access a copy of their Register of Interests as completed
by them.

 

As this information is already reasonably accessible to you, it is exempt
from disclosure under section 21(1) of the Freedom of Information Act
2000.

 

Section 21 of the Freedom of Information 2000 provides that:

 

“(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.

 

(2) For the purposes of subsection (1)—

 

(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment…”

 

2)      If you hold records relating to historical registers of interest
for current and former elected politicians I would be grateful if you
could also supply them.

Crawley Borough Council’s Response

We currently have 36 elected Councillors, however our electronic records
date back to the year 2000 and document over 70 individual Committees at
which Councillor declarations could be made. In order to retrieve and
prepare the information requested from all the records held and
accessible, it would exceed the appropriate limit under the Freedom of
Information Act, and consequently the information is exempt under section
12 of this Act.

 

Further, you have not stated which years you require the information for.

 

Section 12 (1) of the Act states that a public authority is not obliged to
comply with a request for information if the authority estimates the cost
of complying with the request would exceed the “appropriate limit”.  For
the Council, the “appropriate limit” is up to 18 hours of work, or £450 
at £25 an hour, on one request.  This information is set out in the
Freedom of Information (Fees & Appropriate Limit) Regulations 2004.

 

3)      I would also like to receive a copy of the complete current local
authority Gifts and Hospitality Registers for all elected politicians in a
machine-readable spreadsheet format, including any data that may not be
published on your website.

Crawley Borough Council’s Response

Records of gifts and hospitality received are included within the same
Councillors’ Registers of Interest documents, accessible via the above
link.

 

As this information is already reasonably accessible to you it is exempt
under Section 21 of the Freedom of Information Act as set out above.

As per our response to Q2 – in order to retrieve and prepare the
information requested from all the records held and accessible would
exceed the appropriate 18 hour limit under the Freedom of Information Act,
and consequently the information is exempt under section 12 of the Act.
Further, a time frame has not been specified.

 

5)      Lastly, if you hold a separate register of interests that records
those declared at meetings, please also supply that register in a
machine-readable spreadsheet format. Again, if you hold historical records
of declarations that may not be published on your website, please supply
details.

Declarations of interest made for each meeting can be accessed via this
[4]link. You should select the individual meeting, then the date and
select the minute (which for earlier meetings may be a part of the agenda)
to find the individual declarations of interest made at the meeting.

 

The information is not held in the format you have requested.

 

The information can be accessed from the links above.  The retrieval of
any further data as requested, such as the declarations made at meetings,
would mean retrieving and checking the minutes for each meeting.  This
would take longer than the appropriate limit stated in the Act. To collate
the information in the format you have requested would take longer still.
