Current and historical Registers of Interest data

The request was partially successful.

Dear Braintree District Council,

Please treat this email as a Freedom of Information request.

I would like to receive a copy of the complete current local authority Register of Interest for all elected politicians in a machine-readable spreadsheet format such as a CSV file, including any additional information that may not be published on your website.

If you hold records relating to historical registers of interest for current and former elected politicians I would be grateful if you could also supply them.

I would also like to receive a copy of the complete current local authority Gifts and Hospitality Registers for all elected politicians in a machine-readable spreadsheet format, including any data that may not be published on your website.

If you hold historical records of gifts or hospitality received for current and former elected politicians I would be grateful if you could also supply them.

Lastly, if you hold a separate register of interests that records those declared at meetings, please also supply that register in a machine-readable spreadsheet format. Again, if you hold historical records of declarations that may not be published on your website, please supply details.

I would prefer not to receive the requested information in pdf format files.

If the requested information is published as open data, please could you supply the location where this data can be found.

I look forward to hearing from you in due course.

Yours faithfully,

Ally Tibbitt

Braintree District Council

Dear Ally Tibbitt

I am writing regarding your Freedom of Information request received by the
department on the 25 February 2020

The Freedom of Information Act enables access to information held by the
Council, subject to the exemptions contained within the Act. The Act does
not require the Council to create information to respond to a request if
the requested information is not held, nor to give an opinion or comment.

Please find our response to your Freedom of Information request below:

All the information you have requested is either already reasonably
accessible to you by other means or is no longer held by the authority.

The Council is required by the Localism Act to publish the members’
register of interests for both District and Parish Councils on its
website, and to make it available for inspection at its offices. S21 of
Freedom of Information Act 2000 (FOIA) provides that information is exempt
from disclosure if it is reasonably accessible to the applicant. The
Council therefore is applying this exemption and is not providing the
information to you. As this is an absolute exemption, the Council does not
have to consider the public interest test. The Council notes that you made
a request for the information to be a specific format, but as the
information is exempt from disclosure as it is already in the public
domain and reasonably accessible, the Council is not under an obligation
to provide it in a different format.

Under the Council’s duty to provide advice and assistance under S16 of
FOIA, the Council is directing you to where the information can be found,
as set out below.

I Would Like To Receive A Copy Of The Complete Current Local Authority
Register Of Interest For All Elected Politicians In A Machine-Readable
Spreadsheet Format Such As A CSV File, Including Any Additional
Information That May Not Be Published On Your Website.

All the information is published on the Council’s website and can be
accessed by looking on each individual Councillor’s profile. The
information can be found by following this link -

https://braintree.cmis.uk.com/braintree/...

and then selecting the Member Register of Interests tab.

The Council does not hold any additional information that is not published
on the website.

If You Hold Records Relating To Historical Registers Of Interest For
Current And Former Elected Politicians I Would Be Grateful If You Could
Also Supply Them.

The Council does not hold historical records of the register of interests.
The register of interests is updated for each term of office, and as and
when interests change or are updated. All the information held is that
which is published.

I Would Also Like To Receive A Copy Of The Complete Current Local
Authority Gifts And Hospitality Registers For All Elected Politicians In A
Machine-Readable Spreadsheet Format, Including Any Data That May Not Be
Published On Your Website.

All the entries in respect of the register of gifts and hospitality for
each elected Councillor can be found on the individual profile of each
individual Councillor -

https://braintree.cmis.uk.com/braintree/...

under the Member Register of Interests tab, as item 11 at the bottom of
the page. If nothing is recorded, there is no information.

If You Hold Historical Records Of Gifts Or Hospitality Received For
Current And Former Elected Politicians I Would Be Grateful If You Could
Also Supply Them.

The Council does not hold historical records of the gifts or hospitality
register. The records stay on the current elected Councillor’s profile for
their current term of office.

Lastly, If You Hold A Separate Register Of Interests That Records Those
Declared At Meetings, Please Also Supply That Register In A
Machine-Readable Spreadsheet Format. Again, If You Hold Historical Records
Of Declarations That May Not Be Published On Your Website, Please Supply
Details.

The Council does not hold a separate register of interests declared at
meeting. The information is recorded in the minutes of the relevant
meetings, which can be viewed on the Council’s website

https://braintree.cmis.uk.com/braintree/...

If you disagree with the Council’s decision in respect of your freedom of
information request or are otherwise unhappy with how the Council has
dealt with your request in the first instance you may approach Emma Wisbey
Governance and Member Manager in writing at the following address:
Braintree District Council, Causeway House, Bocking End, Braintree, Essex,
CM7 9HB.

Should you remain dissatisfied with the outcome you have a right of appeal
under S50 of the Freedom of Information Act to appeal against the decision
by contacting the Information Commissioner, Wycliffe House, Water Lane,
Wilmslow SK9 5AF, [1][email address]

Kind regards
