Dear Brighton and Hove City Council,
I am requesting an INTERNAL REVIEW into the responses given by the Council to my specific request for information under the Freedom Of Information Act (F.O.I.). This is for the following reasons:-
1. The responses given are presented in a misleading format.
2. At the Policy and Resources Committee (5/12/2019) and in an earlier F.O.I. response, the DEFERRED CUMULATIVE AMOUNTS OWED TO THE COUNCIL by i360 LTD were given accurately for the period up to 28/6/2019. The CUMULATIVE DEFERRED AMOUNTS UP TO DECEMBER 2019 should be given in a similar format, listing those cumulative amounts up to 31/12/2019.
3. There are also further amounts that i360Ltd owe in addition to the cumulative deferred amounts scheduled in the LOAN AGREEMENT between i360Ltd and the Council up until 30/6/2020 which also need to be added to the cumulative amounts.
4. I reserve the right to take these matters to the Information Commissioners Office if these responses aren't accurately and clearly given in the Freedom Of Information Act request.

Yours sincerely,

Rob Heale

Dear Brighton and Hove City Council,
Thank you for your note regarding the likely response date for the Internal Review that I have requested. I hope that I am able to obtain your response to the Internal Review by 21st October 2020.

Yours sincerely,

Rob Heale

Dear Brighton and Hove City Council,
Please note that I still haven't received a satisfactory reply to my F.O.I. Questions and to my request for an Internal Review. The reasons given for this Internal Review were given in my earlier message to you and the response is long overdue. I reserve the right to take this matter to the Information Commissioner if I haven't received a satisfactory response to my questions which were made under the Freedom Of Information Act.

Yours sincerely,

Rob Heale

Dear Brighton and Hove City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'CUMULATIVE Amounts owed to the Council by i360 Ltd'.

The "answer" to my request for information has appeared as a "blank". This MIGHT be due to technical problems or incompatible I.T. Or this MIGHT be due to deliberate or accidental obstruction.

Could you please also provide me with the details for December 2020.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/c...

Yours faithfully,

Rob Heale

Dear Brighton and Hove City Council,
Please note that I haven't yet received the results of the Internal Review into my questions under the Freedom Of information Act. This is titled " CUMULATIVE Amounts owed to the Council by i360 Ltd". My original request was made on 26th June 2020. I requested the Internal Review, giving the reasons for this request, on 28th July 2020. The response is now LONG OVERDUE. In law, Brighton and Hove City Council should have responded by now because the only information given was in a misleading format and one that wasn't similar to that in the Council's own Agenda/Reports.These important questions need to be answered correctly and in an understandable format for a number of reasons which were stated in the request for an Internal Review.

Yours faithfully,

Rob Heale

Dear Brighton and Hove City Council,
Thank you for your reply to my Internal Review request. Regrettably, the response is still not in a format that is easily read or understood to the general public. The table of statistics within the response is misaligned and doesn't make clear that the amounts are £MILLIONS. It should be clear what the CUMULATIVE AMOUNTS OWED BY i360 Ltd to Brighton and Hove City Council are year by year, including the most recent figure.

When there is a Loan of £36.2 MILLION by the City Council to a private company (and I understand that there is an additional loan of £4MILLION to i360Ltd from Coast to Capital that the Council was also taking on), the Council Tax Payers have a right to know about the repayments that were legally agreed in 2014.

I would be grateful for a clearer and more understandable response from the City Council so that we can resolve this matter.

Yours faithfully,

Rob Heale
