I write to make a request under Freedom of Information.

The chair of this committee is the Vice-Provost for Research.

 

Our response

As you will see within the attached documents, some information has been
withheld. This information is personal data, specifically the names,
contact details, job titles and photographs of UCL employees and third
parties. This information has been withheld under Section 40(2) of the
Freedom of Information Act 2000 (FOIA) by virtue of Section 40(3A)(a).

 

Section 40(2) of the FOIA allows a public authority to withhold
information from a response to a request under the FOIA when the
information requested is personal data relating to someone other than the
requester, and its disclosure would breach any of the data protection
principles.

 

In this case, we believe that the disclosure of the names, contact
details, job titles and photographs could relate to and identify
individuals and therefore would be personal data. The disclosure of these
personal data would not be within the reasonable expectations of the
individuals concerned and it would be unfair to do so; this therefore
breaches the first data protection principle which requires personal data
to be processed fairly and lawfully.

 

As the Section 40(2) exemption is an absolute one, there is no need to
conduct a public interest test.

 

Further information has been withheld on page 66 of the document titled
‘2018 12 03 – T1 2018-19 CHMC Papers-24258667_1_REDACTED’ under the
Section 43(2) exemption.

 

Section 43(2) states that: “Information is exempt information if its
disclosure under this Act would, or would be likely to, prejudice the
commercial interests of any person (including the public authority holding
it).”

 

This information regarding the Bloomsbury Theatre’s projected commercial
and total incomes for 2019-20 has been withheld owing to the prejudice
that would occur to the commercial interests of the University.

Section 43(2) is a qualified exemption and as such a public interest test
must be performed to establish the harm that would occur from disclosure,
and where the balance of interest lies. Please see below for the outcome
of this public interest test.

Public interest test for the application of Section 43(2)

Arguments in favour of disclosure:

o There is a general public interest in transparency and openness with
regards to income received by public authorities.

Arguments against disclosure:

o Disclosing the requested information would mean that companies would
inadvertently be able to calculate the average income we receive, for
which they could use to undercut and offer to another University.
o Disclosing this information would be likely to reduce the University’s
ability to negotiate with organisations, this would ultimately
prejudice the Theatre’s ability to provide as broad and global an
offering as it currently is able to.

 

For the reasons above, we believe the balance of public interest tips in
favour of withholding this information from disclosure.

the purposes of news reporting. However, any other type of re-use, for
example by publishing or issuing copies to the public, will require the
permission of the copyright owner.
