Would you please answer the following questions regarding contractor removal, storage and disposal of waste water, including surface water, generated on the site; with particular reference to Mullberry Waste Ltd, Main Head Office & Treatment Facility, 117-118 Clydesdale Place, Moss Side Industrial Estate, Leyland, PR26 7QS:

1) Mullberry Waste Ltd have been/are, as an ad hoc contractor to Cuadrilla Resources Ltd, collecting and transporting for disposal, waste water, including site surface water, from the Cuadrilla Resources Ltd exploratory gas well site at Preston New Road?

2) Mullberry Waste Ltd were, and remain, confident from sample tests undertaken, either by independent agencies or by Cuadrilla Resources Ltd, that the waste water, including site surface water, they were/are transporting for the treatment and disposal of was/is not contaminated?

3) If tests of the waste water, including site surface water, are being carried out would the Environment Agency please make available all test results, including the dates the tests were undertaken, who conducted the tests and where the water was from, including the surface of the well site.

4) If no testing of all the waste water being removed by Mullberry Waste Ltd was/is being undertaken how can the Environment Agency be absolutely certain that the waste water, including site surface water, being transported for treatment and disposal by Mullberry Waste Ltd is being / will be treated and disposed of correctly?

5) How long is the waste water, including site surface water, generated by Cuadrilla Resources Ltd at their Preston New Road exploratory gas well site being stored by Mullberry Waste Ltd in their tankers prior to safe treatment and safe disposal?

6) How is the waste water, including site surface water, generated by Cuadrilla Resources Ltd at their Preston New Road exploratory gas well site being treated by Mullberry Waste Ltd prior to disposal?

7) Where is the waste water, including site surface water, generated by Cuadrilla Resources Ltd at their Preston New Road exploratory gas well site being treated by Mullberry Waste Ltd prior to disposal?

8) Where are Mullberry Waste Ltd disposing of the waste water, including site surface water, generated by Cuadrilla Resources Ltd at their Preston New exploratory gas well site?

9) On the 12 September 2018 Mullberry Waste Ltd transported decanted surface water from the Cuadrilla Resources Ltd Preston New Road exploratory gas well site. The site surface water is known to be excessively high in both nitrates and nitrates which have a damaging impact on both ecosystems and drinking water. Given this fact, how are the Environment Agency totally confident the waste site surface water being transported on that day from the Cuadrilla Resources Ltd Preston New Road exploratory gas well site is being safely, and legally treated and disposed of according to European Union and United Kingdom regulations? Please publish all correspondence between the Environment Agency and Mullberry Waste Ltd confirming where, and how, the treatment and disposal of waste water, including site surface water, is being carried out.

Road site. Please accept our apologies for the delay in our response.

 

Please see our response below to the questions raised in your email. Your
questions are in blue text, and our response is below in black text.

 

With regard to the above company and their work practices at the
exploratory gas well site known as Preston New Road.

Would you please answer the following questions regarding contractor
removal, storage and disposal of waste water, including surface water,
generated on the site; with particular reference to Mullberry Waste Ltd,
Main Head Office & Treatment Facility, 117-118 Clydesdale Place, Moss Side
Industrial Estate, Leyland, PR26 7QS:

Mullberry Waste Ltd hold the following two permits; EPR
Waste/Installations and Radioactive Substances Regulations. Permit for EPR
Waste/Installations was last inspected on 14 February 2019 and no
non-compliances were found with the permit. Permit for Radioactive
Substances Regulations was issued in August 2018 and will be inspected in
due course.

 

1) Mullberry Waste Ltd have been/are, as an ad hoc contractor to Cuadrilla
Resources Ltd, collecting and transporting for disposal, waste water,
including site surface water, from the Cuadrilla Resources Ltd exploratory
gas well site at Preston New Road?

The Environment Agency can confirm that the named company has been
involved in receiving waste water from the Cuadrilla Resources Ltd site at
Preston New Road.

 

2) Mullberry Waste Ltd were, and remain, confident from sample tests
undertaken, either by independent agencies or by Cuadrilla Resources Ltd,
that the waste water, including site surface water, they were/are
transporting for the treatment and disposal of was/is not contaminated?

The paperwork reviewed during our recent inspection on 14 February 2019
found all surface water collected from site had been sampled and not shown
to contain any contamination of concern. An audit will be scheduled to
assess compliance in further detail of all effluent received from Preston
New Road.

 

3) If tests of the waste water, including site surface water, are being
carried out would the Environment Agency please make available all test
results, including the dates the tests were undertaken, who conducted the
tests and where the water was from, including the surface of the well
site.

Information of this nature is often viewed on site at the time of the
inspection/audit. Surface water analysis was made available for viewing
during the site inspection. Effluent analysis will be collected during a
forthcoming site audit for compliance assessment.

 

4)  If no testing of all the waste water being removed by Mullberry Waste
Ltd was/is being undertaken how can the Environment Agency be absolutely
certain that the waste water, including site surface water, being
transported for treatment and disposal by Mullberry Waste Ltd is being /
will be treated and disposed of correctly?

Effluent removed from Preston New Road is being tested prior to leaving
site. Surface water undergoes analysis when received by Mulberry. The
testing of all effluent will be checked as part of a detailed site audit.
It is the producer and current waste holder’s duty of care responsibility
to ensure that waste water is adequately described on waste transfer note
documentation, the wastewater is handled appropriately, stored, treated
and disposed of in line with their permits and relevant legislation.

 

5) How long is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being stored by Mullberry Waste Ltd in their tankers prior to safe
treatment and safe disposal?

Surface water from site is only stored whilst testing is undertaken and
after testing has been completed this is disposed of without delay. We do
not have a specific timescale of storage prior to disposal.

 

6) How is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being treated by Mullberry Waste Ltd prior to disposal?

No treatment is taking place at Mulberry Waste Ltd, after testing is
complete surface water is discharged with consent to foul sewer.

 

7) Where is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being treated by Mullberry Waste Ltd prior to disposal?

Mulberry Waste Ltd have a number of sites. However the site we have
carried out checks on recently, that have confirmed surface water has been
received, is located at Units 117, 17A, 118 Clydesdale Place, Moss Side
Industrial Estate, Leyland, PR26 7QS.

 

8) Where are Mullberry Waste Ltd disposing of the waste water, including
site surface water, generated by Cuadrilla Resources Ltd at their Preston
New exploratory gas well site?

Surface Water that has been received on site was shown to be discharged to
the foul sewer in agreement with United Utilities.

 

9) On the 12 September 2018 Mullberry Waste Ltd transported decanted
surface water from the Cuadrilla Resources Ltd Preston New Road
exploratory gas well site.  The site surface water is known to be
excessively high in both nitrates and nitrates which have a damaging
impact on both ecosystems and drinking water.  Given this fact, how are
the Environment Agency  totally confident the waste site surface water
being transported on that day from the Cuadrilla Resources Ltd Preston New
Road exploratory gas well site is being  safely, and legally treated and
disposed of according to European Union and United Kingdom regulations? 
Please publish all correspondence between the Environment Agency and
Mullberry Waste Ltd confirming where, and how, the treatment and disposal
of waste water, including site surface water, is being carried out.

This date was not checked during our recent visit to Mulberry Waste Ltd on
14 February 2019. However any contamination will have been treated at the
nearby Waste Water Treatment Works which have a permit and consent with
the Environment Agency. Further compliance assessment will be conducted
during the forthcoming site audit.

Dear Environment Agency,

 

With regard to the above company and their work practices at the
exploratory gas well site known as Preston New Road.

 

Would you please answer the following questions regarding contractor
removal, storage and disposal of waste water, including surface water,
generated on the site; with particular reference to Mullberry Waste Ltd,
Main Head Office & Treatment Facility, 117-118 Clydesdale Place, Moss Side
Industrial Estate, Leyland, PR26 7QS:

 

1) Mullberry Waste Ltd have been/are, as an ad hoc contractor to Cuadrilla
Resources Ltd, collecting and transporting for disposal, waste water,
including site surface water, from the Cuadrilla Resources Ltd exploratory
gas well site at Preston New Road?

 

2) Mullberry Waste Ltd were, and remain, confident from sample tests
undertaken, either by independent agencies or by Cuadrilla Resources Ltd,
that the waste water, including site surface water, they were/are
transporting for the treatment and disposal of was/is not contaminated?

 

3) If tests of the waste water, including site surface water, are being
carried out would the Environment Agency please make available all test
results, including the dates the tests were undertaken, who conducted the
tests and where the water was from, including the surface of the well
site.

 

4)  If no testing of all the waste water being removed by Mullberry Waste
Ltd was/is being undertaken how can the Environment Agency be absolutely
certain that the waste water, including site surface water, being
transported for treatment and disposal by Mullberry Waste Ltd is being /
will be treated and disposed of correctly?

 

5) How long is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being stored by Mullberry Waste Ltd in their tankers prior to safe
treatment and safe disposal?

 

6) How is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being treated by Mullberry Waste Ltd prior to disposal?

 

7) Where is the waste water, including site surface water, generated by
Cuadrilla Resources Ltd at their Preston New Road exploratory gas well
site being treated by Mullberry Waste Ltd prior to disposal?

 

8) Where are Mullberry Waste Ltd disposing of the waste water, including
site surface water, generated by Cuadrilla Resources Ltd at their Preston
New exploratory gas well site?

 

9) On the 12 September 2018 Mullberry Waste Ltd transported decanted
surface water from the Cuadrilla Resources Ltd Preston New Road
exploratory gas well site.  The site surface water is known to be
excessively high in both nitrates and nitrates which have a damaging
impact on both ecosystems and drinking water.  Given this fact, how are
the Environment Agency  totally confident the waste site surface water
being transported on that day from the Cuadrilla Resources Ltd Preston New
Road exploratory gas well site is being  safely, and legally treated and
disposed of according to European Union and United Kingdom regulations? 
Please publish all correspondence between the Environment Agency and
Mullberry Waste Ltd confirming where, and how, the treatment and disposal
of waste water, including site surface water, is being carried out.

hearing from you within the 20 day legal time frame.
