Until May 2021 Croydon Councillors were entitled to free parking permits.

For all passes expiring 31/05/2021 please provide the pass number and which Councillor the pass was registered to.

I trust that this is not subject to confidentiality as it relates to expired passes which should no longer be in use.

Please also share the policy which was valid up until the recent change to emission based charging.

Under emission based charging please provide the number of councillors with passes and how many fall into each charging band.

Further to your email dated 15 May 2022, in which you requested an
Internal Review of the Council’s response to your request for information,
I have now concluded this review and I am able to reply as follows. Please
accept my apologies for the delay in replying to you.

 

In your request for Internal Review, you asked the Council to reconsider
your request as you believed that you had not been provided with the
information requested.

 

In your request for information dated 6 April 2022, you requested the
following information:

The Council responded to you on the 13 May 2022 providing the following
response:

 

“1. For all passes expiring 31/05/2021 please provide the pass number and
which Councillor the pass was registered to.

 

We cannot provide this information as it is personal data.

 

The Council considers this information to be personal information,
withholding of personal data as defined by the General Data Protection
Regulations 2018, falls within the exemption in Section 40 (2) (a) (i)
(Personal Information) of the Freedom of Information Act 2000. This aspect
of your request is therefore exempt from disclosure by virtue of Section
40 (2) (a) (i) of the Freedom of Information Act 2000.

 

It is important to remember that when information is released under the
Freedom of Information Act 2000, it is considered released to the wider
public. Any such disclosure of personal information would not be compliant
with the provisions of the General Data Protection Regulations 2018.

 

2. Please also share the policy which was valid up until the recent change
to emission based charging.

 

The change to emission based charging was a decision taken by the Cabinet
Member following the Cabinet meeting on 25 March 2019 Parking Policy

Section 21 of the Freedom of Information Act 2000 therefore applies,
‘Information reasonably accessible to the applicant by other means’. This
acts as an exemption notice.

 

Section 21 is an absolute exemption and therefore does not require the
public interests balancing test to be applied.

 

This means that the Council is relieved of the duty to communicate the
requested information to an applicant if there is an existing method by
which the information can be obtained, outside of the operation of the
Freedom of Information Act and Environmental Information Regulations.

 

3. Under emission based charging please provide the number of councillors
with passes and how many fall into each charging band.

In your request for an Internal Review dated 15 May 2022, you stated the
following:

 

The requestor has asked the Council to review the response provided as
they consider that they have not been provided with all the information
requested:

 

“I am writing to request an internal review of Croydon Borough Council's
handling of my FOI request 'Croydon Councillor Parking'.

 

Further to my previous request for an internal review you have failed to
accurate respond to question 2. I have asked for the policy relating to
members parking permits, not the policy related to the borough wide
emission based parking changes. Can the correct information please be
provided.”

 

On receiving your request for an Internal Review, I contacted the Parking
Service who have informed me that there was no specific policy for Member
parking permits. The Parking Policy provided stated that Member Permits
are subject to the same emissions, based permit pricing, as other permits.

the right to apply directly to the Information Commissioner for a
