RE: INDEPENDENT REVIEW OF FOI REQUEST TO CROWN PROSECUTION SERVICE – (REF NONE)

I made a freedom of information request to the Crown Prosecution Service (the ‘CPS’) on 1 January 2016. Details can be found on the “what do they know” website at the following address:

You will see from the contents of the above that the CPS had not responded by the 1 February 2016 deadline and on the 8 February I notified it about the delay which was not responded to and so submitted a request for review on 1 June on the grounds that there had been no response.

I communicated on 8 July to the CPS that if it had not responded by 12 July I would assume it would have no intention of doing so and prefer that I escalate the matter to the Information Commissioner.

In essence, the CPS has not responded to any of the communications.

"RESPONSE

In response to your request, the CPS independently reviews cases in line with the principles set out in The Code for Crown Prosecutors. I enclose the below link for ease of reference.

This requires the CPS to ensure there is sufficient evidence and to consider whether a prosecution is in the Public interest. The CPS holds no information that a Prosecutor has been threatened or bribed to prosecute a case that is not compliant with the Code for Crown Prosecutors. "

I suppose the CPS has complied with the FOIA in so much as it has stated it has no records held about being threatened or bribed by Humberside Police to prosecute a case that is not compliant with the Code for Crown Prosecutors. Whether it can be believed that the situation has never arisen is another matter completely.
