Crown Court Manual

Rachael Bates made this Freedom of Information request to Her Majesty's Courts and Tribunals Service

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Her Majesty’s Courts and the Tribunals Service,

I have been following a request on the WhatDoTheyKnow website for the Crown Court Manual (I'm a law student and have an interest in the information requested) and you seem to be taking so long over some daft review process that I thought it would be quicker to make my own.

So:
Please send me an electronic copy of the entire Crown Court Manual. By entire I mean including every single chapter, sub-chapter, appendix, annex, foreword, afterword, epilogue and any material which forms a part of the Crown Court Manual.

Yours faithfully,
Rachael Bates

Dear Lark, Alex,

Thank you for your response.

Please note that you are in breach of section 16 of the Freedom of Information Act (requirement to provide advice and assistance) and paragraph 14 of the statutory code of practice (stating that public authorities "should consider providing an indication of what, if any, information could be provided within the cost ceiling"). This is not a request for an internal review but note that I am dissatisfied.

I also notice that the contents list you emailed me contains two Appendix A-s, which is most enlightening. Thank you.

Please could you provide me with an electronic copy of the following sections promptly and in any event not later than the twentieth working day following today's date:

Section 3 Allocation of business
Section 6 Attendance of judges and lay justices in the Crown Court
Section 10 Appeals to the Crown Court etc
Section 11 Civil jurisdiction of the Crown Court
Section 16 Listing
Section 17 Ex-parte
Section 18 Process to compel appearance before the Crown Court
Section 19 Jurors
Section 20 Court reporting
Section 22 Contempt of court proceedings
Section 26 Appeals to the Court of Appeal Criminal Division and the High Court
Section 27 Claims for judicial review
Section 28 Application to state a case (s 28 Supreme Court Act 1981)
Section 33 Technology in the Crown Court
DARTS - Training Manual County Court Clerks
DARTS - Training Manual Crown Court Clerks
DARTS - Training Manual Court Ushers

If you cannot provide all of this material due to the cost limit, please omit sections 16, 18, 27 and 28 and provide everything else. If you still cannot provide all of this information due to the cost limit then provide (as you should have done already) some indication of what would be possible.

Yours sincerely,
Rachael Bates

Dear Alex,

It is utterly unacceptable that you are proposing to extend the statutory deadline by THREE MONTHS. The courts service is supposed to uphold the law, not subvert it. I am complaining to the information commission.

Yours sincerely,
Rachael Bates

It appears the full Crown Court Manual was eventually released, following a decision by the Information Commissioner, at:

https://www.whatdotheyknow.com/request/g...

The released document is heavily redacted though.
