Crohn's Disease

The request was successful.

Dear Department for Work and Pensions,

In cancelling someone with SEVERE Crohn's disease DLA payments, what factors would have been considered?

Yours faithfully,

J Newman

Dear DWP Adelphi Freedom-of-Information-Request,

Thank you - I have read your letter and the links it included, but need your help further.

The point with Crohn's disease is that the effects are both highly debilitating and highly variable which the claimant will have described on the ESA50. The WCA might well have been on a "good" day when the person's work capability might look ok. The HCP would not have the wherewithal to confirm the diagnosis but would have a GP's notification. HCPs and DMs both have to account for condition variability, so how would they do this here? On the one hand they have a confirmed diagnosis, but at the WCA nothing appears to be wrong.

Yours sincerely,

J Newman

Dear DWP Adelphi Freedom-of-Information-Request,

Thank you, this is quite clear. This means that a HCP could be faced with making an assessment based not on factors they can see and test on the day, but on intricate aspects of the condition and its typical variable effects.

HCPs however are not required to have detailed diagnostic & clinical experience and could only be qualified in physiotherapy. No amount of training in disability assessment serves as a substitute for this knowledge.

Should all HCPs therefore be qualified doctors as you have indicated in your IR response?

Yours sincerely,

J Newman

Hi,

I'm trying to get together a few people with severe BD to look into legal action against the DWP DMs - possibly getting the NACC involved. Could you post here if interested?

Cheers.
