Dear House of Commons Administration Committee,

Can you please let me know if any current Members of Parliament have a criminal conviction. If so, how many MPs have a criminal conviction and what crimes are the convictions for and if any have served time in jail?

Yours faithfully,
Adrian J Cohen

Dear Mr Cohen

Freedom of Information Request F18-094

Thank you for your request for information copied below. You have asked
two questions about MPs which we have sought to answer below.

 1. Do any current Members of Parliament have a criminal conviction and,
if so, how many?

And

 2. What crimes these convictions were for and if any MPs have served time
in jail?

In the first instance it may help you to know that MPs are not required to
disclose details of criminal convictions to the House of Commons.

However, some of this information is held by the House of Commons,
collected from publicly available sources.

Some information about convictions of current members while they have been
MPs is held by the House of Commons. This is published as a Research Paper
on the parliamentary web pages here:
[1]http://www.parliament.uk/briefing-papers....

As this part of your request is reasonably accessible to you otherwise
than under the Freedom of Information Act 2000 (FOIA) your request is
refused. In refusing your request the House is applying the exemption set
out in section 21 (1) and (2) (a) of the FOIA.  This is an absolute
exemption and the public interest test does not apply.

Information about convictions of individuals before they became MPs is not
held by the House of Commons. On this occasion we are unable to identify
any other public authority from whom you may be able to request this
information.  Further, the information you require constitutes personal
data and is therefore likely to be exempt from disclosure under Data
Protection provisions.

No other information is held by the House of Commons. You may wish to
consider contacting individual MPs to ask for the information you seek;
contact details are available at:
[2]http://www.parliament.uk/mps-lords-and-o... However, Members
of Parliament are not public authorities for the purposes of the Freedom
of Information Act.  This means that they are not obliged to respond to
requests made under the Act.  Similarly, the Act does not apply to
political parties.

You may, if dissatisfied with the handling of your request, complain to
the House of Commons. Alternatively, if you are dissatisfied with the
outcome of your request you may ask the House of Commons to conduct an
internal review of any decision regarding your request.  Complaints or
requests for internal review should be addressed to: Information Rights
and Information Security Service, Research & Information Team, House of
Commons, London SW1A 0AA or [3][House of Commons Administration Committee request email].  Please ensure
that you specify the full reasons for your complaint or internal review
along with any arguments or points that you wish to make.

If you remain dissatisfied, you may appeal to the Information Commissioner
at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF,
[4]www.ico.gov.uk.

Yours sincerely,

Jean Fessey | Information Rights Officer
Information Rights and Information Security (IRIS) Service | House of
Commons
