Criminal Records?

We're waiting for Duncan to read a recent response and update the status.

Dear Canal & River Trust,

Please can you supply me with the number of employees within the trust, and how many of those employees have criminal records, current or spent?
Employees have a legal obligation to declare criminal convictions on their job application form, and the CRB checks which should have been made by the trust for each C&RT employee should reveal the exact number?

Dear Duncan,

Thank you for contacting the Canal & River Trust with your request for information. The Trust has treated your request as a request for information under the Freedom of Information Act 2000.

Please can you supply me with the number of employees within the trust, and how many of those employees have criminal records, current or spent?

The current number of employees employed directly with the Trust, as of today’s date is 1672. We don’t have a record of how many of these employees have criminal records, current or spent. It is a question asked as part of the recruitment process and if an individual ticks yes to this, we request further information and if we’re satisfied with the details, we would proceed with the offer of employment but again, we don’t maintain a record of the numbers of employees with criminal records.

CRB checks are now known as DBS checks, The trust conducts DBS checks but only for certain roles and the trust does not keep a record of how many of those have had criminal convictions.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. Internal review requests should be submitted within two months of the date of this email and should be sent by email to [email address] or by post to Information Officer, Legal Department, Canal and River Trust, Aqua House, 20 Lionel Street, Birmingham, B3 1AQ. You are also able to contact the Information Commissioner by telephoning 0303 123 1113 although please note they would usually expect you to have gone through our internal review procedure before contacting them.

Dear Information Request,

Can you please 'legally confirm' you are saying you have no idea how many criminals work for the Canal & River Trust?

Can you at least supply the number of Licence Support Officers that work for the trust, and how many of those have criminal records? If you cannot answer this question, can I request by Name/Occupation whether these individuals have a criminal record?

Or

How many Licence Support Officers work On the River(s) Lee/Stort, and are there any criminal convictions on their Employment Application forms?

I.E. Does Kevin Oneill (Licence Support Officer for the River Lee/Stort) have any declared criminal convictions?

Dear Duncan,

Thank you for contacting the Canal & River Trust with your request for information. The Trust has treated your request as a request for information under the Freedom of Information Act 2000.

As previously stated, it is a question asked as part of the recruitment process if an individual ticks yes to this, we request further information and if we are satisfied with the details, we would proceed with the offer of employment but again, We do not maintain a record of those.

The trust does conduct DBS checks for but only for certain roles and the trust does not keep a record of how many those had criminal convictions.

Having reviewed your request, we estimate it would take the Trust over 18+ staff hours (calculated at £25 per hour in accordance with ICO guidance) to locate the application forms of Licence Support Officers amongst the 1672 staff that work at the Trust and add up the total number of convictions for that employee category.

On this basis we have declined your request as the cost of compliance exceeds the
appropriate limit under section 12.

The Trust would be unable to disclose under the Freedom Of Information Act 2000 if certain individuals have criminal convictions as this is exempt from disclosure under section 40 of the Freedom Of Information Act as this constitutes as personal data.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review.
