following

1. The number of employees in your authority that are employed to
undertake criminal investigations.
2. Details of the designation of all of the above employees.
3. The number of the above employees who have undertaken training
in respect of Part 6 of the Criminal Justice and Licensing
(Scotland) Act 2010.
4. If any of the above employees have not undertaken training in
respect of Part 6 of the Criminal Justice and Licensing (Scotland)
Act 2010 please provide details of procedures in place to reduce
the risk of miscarriages of justice occurring.

Request for Information

I refer again to your e-mail dated 13 May 2015 seeking information in relation to employees that are employed to undertake criminal investigations.

Having investigated, my response to your questions 1-5 is as follows:-

(1) No staff are employed solely for the purposes of undertaking criminal investigations.

(2), (3)
& (4) Not applicable.

(5) The number of employees are as follows:-

Senior Investigating Officer – 35
Reviewing Officer – 16
Reporting Officer – 77

I can advise that North Lanarkshire Council, having regard to the provisions of Section 21 of the Freedom of Information (Scotland) Act 2002, has established a procedure whereby any person who has requested information and is in any way dissatisfied with the decision on that request, can within forty working days require a review of that decision by writing to the Executive Director of Corporate Services, Civic Centre, Windmillhill Street, Motherwell ML1 1AB. Accordingly, if you are dissatisfied with this decision and seek such review please write to the Executive Director of Corporate Services.

I would advise, also, that in terms of Section 47 of the Act a person who is dissatisfied with a notice given by the local authority under Section 21 of the Act - ie. a notice following a review of a decision by a local authority, or by the failure of a local authority to give such a notice - may make application to the Scottish Information Commissioner for a decision as to whether, in any respect specified in that application, the request for information to which the requirement relates has been dealt with in accordance with the Act. Such an application must be in writing or in another form which, by reason of it having some permanency is capable of being used for subsequent reference - for example a recording made in audio or video tape - must state the name of the applicant and an address for correspondence and must specify the request for information to which the requirement for review relates, the matter which gave rise to the applicant’s dissatisfaction with the original decision of the local authority and the matter which gives rise to the applicant’s dissatisfaction with the decision on review by the local authority or the failure of the local authority to issue such a decision. Dear North Lanarkshire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of North Lanarkshire Council's handling of my FOI request 'Criminal Investigations'.

Thank you for your limited response to my enquiry. I would like to confirm that I did not use the word solely in question 1 therefore find your response very disappointing, particularly that other local authorities have responded with a substantive response to the same question.

For clarification I am asking for the number of employees who undertake criminal investigations not solely undertake criminal investigations. I would like to think that this now provides adequate clarification for questions 1 - 4 to be answered. To avoid any misunderstanding examples of your officers that I refer to are trading standards, environmental health, planning enforcement, fraud, or any other officer who would undertake any enquiries, at any stage of their employment, that could result in submission of a report to crown office and procurator fiscal service.

I trust that if any further clarification is required you will be able to request this from myself.
